Clarifying contents that are not in accordance with the provisions of the Law on National Defense Industry, Security and Industrial Mobilization

On the afternoon of November 8, discussing at the Group on the draft Law on National Defense Industry, Security and Industrial Mobilization, National Assembly Delegate Nguyen Thi Phu Ha ( Hoa Binh ) said: The drafting agency and the reviewing agency need to carefully review the contents related to support funding; at the same time, clarify the contents that are not in accordance with the provisions of the law.

According to National Assembly Deputy Nguyen Thi Phu Ha, the promulgation of the Law on Defense Industry, Security and Industrial Mobilization is necessary. However, through studying the provisions of the Law, it can be seen that this Law is related to and has a great influence on other Laws. In particular, in the field of budgetary finance, the relevant provisions in the provisions clearly show that priority should be given to defense industry investment, but the contents are different from the provisions of the State Budget Law. Therefore, it is recommended to consider implementing it according to the principles of the State Budget Law.

Similarly, regarding the Law on Bidding, the delegate said that there are matters directly related to the appointment of contractors that need to be reviewed to see if they are in accordance with current laws. If they are presented, there must be evidence and appropriate explanations. On the other hand, when assigning tasks to enterprises, it is also necessary to clarify whether it is an assignment or an order. The delegate suggested that the drafting agency and the reviewing agency should clarify the contents that are not in accordance with the provisions of the law and have a specific report.

Regarding the planning content in Clause 4, Article 6 of the draft Law, it is stipulated: "Planning for construction and development of the national defense industry, planning for construction and development of the security industry is national sector planning. The process of formulating, appraising, approving, promulgating, and adjusting planning for construction and development of the national defense industry, planning for construction and development of the security industry shall comply with the provisions of Article 9 of this Law; in cases not yet specified in Article 9, the provisions of the law on planning shall apply". The delegate said that this issue needs to be clarified on how to implement it.

According to delegate Nguyen Thi Phu Ha, in order to ensure resources for national defense and security, the competent authority should consider whether it is necessary to include this content in the decision on investment programs and projects. On the other hand, it is necessary to clarify the content on the use of technology innovation funds, high-tech venture capital funds and other funds in the field of science and technology. In particular, the drafting agency and the reviewing agency should consider more carefully the review of the provisions related to funding in the draft Law.
