At the trial, defendant Ngoc Trinh testified that she did not intentionally violate the law. "I had intended to take the A2 driving test," the model Ngoc Trinh stated during the trial on the morning of February 2nd.
According to Ngoc Trinh's testimony, she was the one who proactively arranged the date and time with defendant Tran Xuan Dong to practice driving; Dong was responsible for preparing the vehicle and the location for practice. Furthermore, she thought that driving and practicing on a deserted road would be safe.
"The defendant did not assign anyone tasks; it was simply a daily habit," Ngoc Trinh testified.

Presiding judge: "Who instructed the defendant?" Ngoc Trinh testified: "Teacher Dong was the instructor. Teacher Dong demonstrated the movements for me to see, and then I performed them with him."
Ngoc Trinh stated that each time she went to practice, the people accompanying her to film and assist her were Nguyen Thi Thuy Kieu (Ngoc Trinh's assistant), Mr. Nguyen Thanh Long, Mr. Nguyen Hoang Son, Ms. Le Thi Hong Nhung, and Mr. Tran Ngoc Kien.
During questioning of Ngoc Trinh, the representative of the Ho Chi Minh City People's Procuracy stated that the defendant's claim of practicing driving to pass the A2 driving test was unreasonable.
"While researching and watching videos online, I saw girls performing maneuvers while riding motorcycles, so I was momentarily intrigued and wanted to try it myself," Trinh confessed.
"The defendant acted impulsively and was overly confident, so she wanted to carry out those actions," Trinh said, her voice choked with emotion, on the verge of tears. At that moment, the prosecutor reminded Trinh to calm down.
The prosecutor asked: "What was the defendant's purpose in posting the video on social media?" Ngoc Trinh replied: "To keep as a memento."
The prosecutor questioned: "Memories should be kept private, the defendant must know her place in society." Ngoc Trinh replied: "I posted them on social media as a keepsake because my phone wasn't big enough to store them. Social media sites are where I keep my memories."
After Ngoc Trinh answered the questions, the prosecutor stated that the defendant was still being evasive about her purpose in posting the videos on social media.
Ngoc Trinh stated: "The defendant has acknowledged her wrongdoing and does not wish to deny it. The defendant affirms that when she uploaded the video to social media, it was only to preserve memories. While practicing, the defendant was unaware that the road she was practicing on had already been put into use."

In response to the court, defendant Tran Xuan Dong testified that he had never taught at driving schools before; he only taught clients outside of driving schools and BMW customers.
Dong further testified that when they arrived at the training ground, he would run first, performing the movements, and then Ngoc Trinh would repeat them. Assisting Dong was Mr. Nguyen Hoang Son.
Furthermore, Dong stated that four motorcycles were seized during the investigation. “I like motorcycles, so I bought a few. Of the four seized, three belong to me, and one belongs to Ngoc Trinh.” Regarding the origin of the vehicles, Dong stated the same as in the indictment, and admitted that he “was aware that buying vehicles of unknown origin is a violation of the law.”

According to Dong's testimony, at the time of purchasing the vehicles, because he didn't have much money but liked motorcycles, he accepted buying several vehicles without proper documentation.
According to the indictment, model Ngoc Trinh is being tried for "disrupting public order" under point a, clause 2, Article 318 of the Penal Code, committing the crime in an organized manner, with a penalty of 2 to 7 years in prison.
Defendant Tran Xuan Dong is being tried for two offenses: "disrupting public order" under point a, clause 2, and "using forged documents of an agency or organization" under clause 1, Article 341 of the Penal Code.
The indictment states that Ngoc Trinh did not have a driver's license for motorcycles with an engine capacity of 175 cc or more (Class A2 license), but Trinh conspired with Tran Xuan Dong to prepare large-displacement motorcycles and choose locations for driving. At the same time, Trinh assigned her assistant Nguyen Thi Thuy Kieu and Nguyen Thanh Long (Trinh's driver), as well as Tang Duy Khanh (Long's friend) and Nguyen Hoang Son (Dong's assistant), to prepare phones and drones for filming.
On September 5th, 6th, and October 6th, 2023, Trinh and Dong rode large-displacement motorcycles and performed dangerous driving maneuvers such as letting go of the handlebars, lying down, and kneeling on the seat... on various public roads in Thu Duc City, Ho Chi Minh City; causing negative impacts on public order and traffic safety.
Subsequently, Trinh edited and reposted the videos and images of dangerous driving to her personal social media accounts, including: TikTok "Ngoc Trinh" (5 videos, receiving 478,000 likes and 4,881 comments); Facebook "Tran Thi Ngoc Trinh (the girl who eats out)" (attracting 5,900 interactions); and the Fanpage "NGOC TRINH" (video of her driving a large-displacement motorbike and having an accident resulting in injury).
On October 19, 2023, Ngoc Trinh and Dong were arrested and detained, and confessed to all their crimes.
