Human resources and funding for lawmaking are not commensurate.

On the morning of March 7th, reporting on the implementation of laws and resolutions passed by the 15th National Assembly at its 6th session and 5th extraordinary session in 2023, Deputy Prime Minister Tran Luu Quang stated that the Government had approved 49 proposals for drafting laws, draft laws, and draft resolutions; issued 93 decrees and 1 joint resolution; and the Prime Minister issued 33 normative legal decisions.

In 2023, in addition to regular sessions, the Government held 10 thematic sessions on lawmaking; the Standing Committee of the Government regularly discussed and provided feedback on proposals for drafting laws and draft resolutions; Government leaders intensified direct work with ministries, sectors, and localities to provide feedback and guidance on major, complex issues, and issues where there were differing opinions in each draft law and draft resolution.

Regarding the implementation of laws and resolutions passed by the National Assembly at its 6th Session and 5th Extraordinary Session, the Deputy Prime Minister stated that after the conclusion of the National Assembly's sessions, the ministries and ministerial-level agencies responsible for drafting the laws and resolutions have advised and submitted to the Prime Minister, or issued within their authority, plans for the implementation of the laws and resolutions passed by the National Assembly.

In some localities, research is underway to issue separate documents directing and guiding the development of implementation plans for laws and resolutions, which include assigning specific responsibilities to relevant departments and agencies for widespread implementation among the people at the grassroots level.

Regarding the dissemination of newly enacted laws and resolutions, after the laws and resolutions were passed by the 15th National Assembly at its 6th Session and 5th Extraordinary Session, the Deputy Prime Minister stated that the dissemination of these laws and resolutions has been carried out.

Specifically, most ministries, sectors, and localities have integrated the content of directives and guidelines for disseminating new laws and resolutions into their 2024 legal education and dissemination work plans; 27 out of 63 provinces and cities have developed plans and official documents guiding the dissemination of new laws and resolutions; ministries and ministerial-level agencies have organized training conferences and compiled materials to serve the dissemination and introduction of laws and resolutions to citizens and businesses.

The Ministry of Justice has issued a document coordinating with ministries and agencies responsible for advising on the drafting of new laws and ordinances to compile introductory materials for 7 laws.

In addition, building on the foundation of online journalism applications on social media and websites, ministries and ministerial-level agencies are also implementing measures to promote communication and bring the content of laws and resolutions into practice as soon as possible.

Referring to some difficulties and obstacles in the process of implementing laws and resolutions, the Deputy Prime Minister said that the content of the detailed regulations is quite large, and the tight timeframe for issuance leads to difficulties in ensuring the simultaneous effectiveness of the detailed regulations with the laws and resolutions issued by the National Assembly.

Many difficult and complex issues cannot be regulated in law and are delegated to the Government and the Prime Minister for detailed regulation, leading to difficulties in drafting and promulgating them. The dissemination of new laws, ordinances, and resolutions in some ministries, sectors, and localities is also not being implemented in a timely manner.

Furthermore, resources for law enforcement are limited: there is a shortage of staff involved in lawmaking, law enforcement, and legal affairs, and many of them are juggling multiple responsibilities. Funding for lawmaking is also limited and not commensurate with the volume of work required in lawmaking and law enforcement.

To further improve the quality of the implementation of laws, ordinances, and resolutions of the National Assembly, the Standing Committee of the National Assembly, the Government, and the Prime Minister will focus on implementing a comprehensive set of tasks and solutions such as: Issuing, within their authority, plans for the implementation of laws and resolutions; strengthening the dissemination of newly enacted legal documents; promoting legal education and awareness through various forms, tailored to specific target groups; focusing on professional training and development for civil servants in specialized units of ministries, departments, and local agencies assigned to advise on and organize the implementation of laws and resolutions, especially specialized laws with many new and complex contents such as the Land Law, the Law on Credit Institutions, the Telecommunications Law, and the Identity Card Law…

In addition, the drafting organization issued 56 detailed regulations on schedule and with quality, ensuring that the detailed regulations have the same effect as the regulations being detailed, in order to bring the laws and resolutions into practice as soon as possible.
