The government has recently issued a Decree stipulating the functions, tasks, and powers of national universities. Accordingly, this decree applies to national universities, agencies, organizations, and individuals involved in the management and operation of national universities.
According to Article 2 of the Decree, a national university is a public higher education institution managed by the Ministry of Education and Training, possessing legal personality, its own bank account, and using a seal bearing the national emblem.
National universities have the function of providing high-quality, multidisciplinary, and multi-field higher education, scientific research, and technology transfer; some of their training fields are leading in the country and highly ranked internationally.
National universities are subject to state management by the Ministry of Education and Training, the Ministry of Science and Technology, other ministries and agencies, and the People's Committees at all levels where the national universities are located, in accordance with the law.
What are the duties and powers of a national university?
National universities have the duties and powers as stipulated in the Law on Higher Education; the Law amending and supplementing certain articles of the Law on Higher Education; other legal provisions and the provisions of this Decree.
Regarding organizational structure and personnel, the National University manages its organizational structure and personnel in accordance with the law, the Regulations on Organization and Operation of the National University and its member higher education institutions; implements personnel procedures to report to the Ministry of Education and Training for submission to the Prime Minister for appointment and dismissal of the chairman of the National University Council, the director of the National University, and the deputy director of the National University in accordance with Party regulations and relevant laws; submits to the Ministry of Education and Training for recognition of the National University Council in accordance with Party regulations and relevant laws.
The National University decides and reports to the Prime Minister and the Ministry of Education and Training on the addition or replacement of members of the National University Council (except for members specified in point b of this clause).
National universities also issue regulations on the working regime of lecturers and researchers in accordance with applicable laws to attract and develop high-quality human resources domestically and internationally; Decisions on concluding labor contracts with reputable lecturers, scientists, and experts domestically and internationally in accordance with the law to ensure teaching and scientific research needs; Decisions on appointing national university officials to participate in the management and operation of enterprises under the national university in accordance with the law.
Regarding training activities, the national university will develop and improve the quality of higher education to train high-level human resources, meeting the requirements of socio-economic development and ensuring national defense and security; promote international cooperation and integration to develop Vietnamese higher education to be on par with the region and the world; and develop regulations for training at all levels of higher education, reporting to the Minister of Education and Training for promulgation in accordance with the Law on Higher Education and other relevant legal regulations.
National universities develop and implement practical, specialized, and gifted training programs at all levels to identify, train, and nurture scientific and technological talents; and implement training programs already conducted domestically abroad through international cooperation and linkage programs in accordance with the law.

National universities set tuition fees in accordance with government regulations.
Regarding finance and assets, the Decree stipulates that the National University is a first-level budget-estimating unit assigned a budget by the Prime Minister; it uniformly manages the allocation and assignment of budget estimates to its member units, affiliated units, and units directly under the National University; and it is responsible for the accounting and budget settlement of the National University in accordance with current laws on state budget.
The National University manages, operates, and oversees the unified financial and asset management within the National University in accordance with the laws on state budget, the laws on the management and use of public assets, and other relevant laws; it approves the financial autonomy plans of its member units, affiliated units, and units directly under the National University in accordance with the Government's regulations on the financial autonomy mechanism of public non-business units.
Notably, the national university is responsible for setting tuition fees within the national university system according to government regulations; managing, operating, utilizing, and sharing assigned financial, human, physical, and other resources throughout the national university, ensuring organic, synchronized, and effective management; mobilizing social resources to build the national university into a research-oriented higher education institution of regional and international stature; and receiving priority investment from the State to fulfill national strategic tasks and regional development objectives.
National universities are accountable to the Government, the Prime Minister, ministries, agencies, students, and society for their activities within the scope of their assigned functions, tasks, and powers. These units work directly with ministries, ministerial-level agencies, government agencies, and provincial and city People's Committees to resolve issues related to the national university. When necessary, the national university reports to the Prime Minister on issues related to its operation and development; provides information and reports to support inspection and auditing activities by relevant ministries, agencies, and provincial People's Committees where the national university, its member units, and affiliated units are located, in accordance with the law.
The Decree stipulating the functions, tasks, and powers of national universities will take effect from September 1, 2025, replacing Decree No. 186/2013/ND-CP dated November 17, 2013, of the Government on national universities.
Currently, there are two national universities in Vietnam: Hanoi National University and Ho Chi Minh City National University. Prior to this, at the end of last year, a document outlining the government's plan for restructuring and streamlining the organizational apparatus included a section concerning the reorganization of the two national universities. According to this plan, it was proposed that the two national universities be transferred to the Ministry of Education and Training for management.
