Regulations on national database catalog and construction, updating, maintenance, exploitation and use

With the aim of promoting data creation through the implementation of construction, development, connection, sharing and exploitation of national databases and specialized databases to serve socio -economic development, on May 9, 2024, the Government issued Decree No. 47/2024/ND-CP regulating the list of national databases; the construction, updating, maintenance, exploitation and use of national databases.

National database is a database of one or several socio-economic fields that is built, updated and maintained to meet the information access and usage requirements of economic sectors and serve public interests.

In general principles, the National Database is built, exploited and used uniformly from the central to local levels. The national database information system is managed, built and maintained centrally. The construction, collection, updating, management, maintenance, exploitation, connection, sharing and use of national databases must comply with the provisions of law on the protection of state secrets and military and national defense.

The Government is the owner of the data and has unified management of the data. The Government assigns the National Database Manager to manage, exploit and use it according to its functions and tasks. The Ministry of Information and Communications manages the state in organizing, managing and using information resources and national databases. The agency at which level the data arising from specialized state management activities is responsible for updating the data accurately and promptly into the national database.

Compliance with regulations on management, connection and sharing of digital data of national databases is carried out regularly and continuously from the design, construction, update, maintenance, exploitation and use stages; ensuring unified connection between national databases and other databases and information systems through the National Data Integration and Sharing Platform; complying with technical standards, regulations and the Vietnam e-Government Architecture Framework; complying with relevant specialized legal regulations.

Regulations on shared databases

Currently, the development of databases and the connection of databases are taking place vigorously. To implement the Law on Electronic Transactions 2023, the Ministry of Information and Communications is being assigned to preside over the development of a Decree regulating shared databases to promptly institutionalize the policies and viewpoints of the Party and State on promoting digital transformation, developing and effectively exploiting data to serve socio-economic development and digital government development in the coming period.

The draft Decree inherits the provisions issued in Decree No. 47/2020/ND-CP and especially inherits the entire content of Decree No. 47/2024/ND-CP, which was recently issued on May 9, 2024; Adds some new contents related to data sharing to suit the implementation situation in the recent past. Thereby, the draft Decree details 3 contents that the Law on Electronic Transactions 2023 assigned the Government to detail:

Regarding the content on construction, updating, maintenance, exploitation and use of national databases : The Decree conveys the entire content and replaces Decree No. 47/2024/ND-CP, which was recently issued by the Government on May 9, 2024, due to changes in legal basis when the Law on Electronic Transactions takes effect from July 1, 2024.

Regarding the content of data connection and sharing : Decree No. 47/2020/ND-CP dated April 9, 2020, the Government has fully regulated the connection and sharing of data. Therefore, this Decree adds the content of regulations on electronic transactions through connection and sharing of data to carry out inter-agency operations; Further clarifying the intermediary system in connection and sharing of data and the concept of the National Digital Architecture Framework mentioned in the Law on Electronic Transactions 2023.

Regarding the content of open data : Decree No. 47/2020/ND-CP dated April 9, 2020, the Government has provided basic and complete regulations on open data. Therefore, this Decree will refer to existing regulations; adding regulations on conditions to ensure the implementation of regulations on open data as detailed in the Law on Electronic Transactions 2023.

Regulations on standards for connection and data sharing

Data standards include basic standards for data in information technology and data structure standards that indicate the content and information of data. Currently, there are not many data that have standards for data structure, including: population data, land, insurance, and civil servants. Therefore, the Ministry of Information and Communications is responsible for presiding over and developing common standards for data and information technology to guide ministries, branches, and localities in developing data standards. On that basis, ministries, branches, and localities are responsible for developing data standards for data structure within the scope of their industries, fields, and databases.

To promote the development and completion of the data standards system, the Ministry of Information and Communications has also issued guidance document No. 1016/BTTTT-CĐSQG to ministries, branches and localities to guide the development and application of standards, technical regulations and standards for data connection and sharing.

However, the standards for data structures in specialized fields issued by ministries and localities are still limited and incomplete, only a few basic types of data have been built, and the form of issuing data structure standards has not been synchronized. Therefore, each ministry and sector needs to build data standards within the sector to clearly distinguish which data is built by the central government and which data is built by localities according to unified standards. On the basis of specialized data standards, database owners will build technical regulations to share data externally./.
