With the aim of promoting data creation through the construction, development, connection, sharing, and exploitation of national and specialized databases serving socio-economic development, on May 9, 2024, the Government issued Decree No. 47/2024/ND-CP regulating the list of national databases; the construction, updating, maintenance, exploitation, and use of national databases.
A national database is a database covering one or more socio-economic sectors, built, updated, and maintained to meet the information access and usage requirements of economic sectors and serve the public interest.
In general, the national database is built, exploited, and used uniformly from the central to local levels. The national database information system is managed, built, and maintained centrally. The construction, collection, updating, management, maintenance, exploitation, connection, sharing, and use of national databases must comply with the legal regulations on the protection of state and military secrets and national defense.
The government owns and manages the data in a unified manner. The government assigns the National Database Administrator to manage, exploit, and utilize the data according to their functions and responsibilities. The Ministry of Information and Communications is responsible for the state management of the organization, management, and use of national information resources and databases. Data generated from specialized state management activities at a particular level of government agency is the responsibility of that agency to update the national database accurately and promptly.
Compliance with regulations on the management, connection, and sharing of digital data in the national database is carried out regularly and continuously from the design, construction, updating, maintenance, exploitation, and use stages; ensuring unified connectivity between the national database and other databases and information systems through the National Data Integration and Sharing Platform; adhering to technical standards and regulations and the Vietnamese e-Government Architecture Framework; and complying with relevant specialized legal regulations.
Regulations regarding shared databases
Currently, the development and connection of databases are progressing rapidly. To implement the 2023 Electronic Transactions Law, the Ministry of Information and Communications is tasked with leading the development of a Decree regulating shared databases to promptly institutionalize the Party and State's policies and viewpoints on promoting digital transformation, developing and effectively utilizing data to serve socio-economic development and the development of a digital government in the coming period.
The draft Decree inherits the regulations issued in Decree No. 47/2020/ND-CP and, in particular, inherits the entire content of Decree No. 47/2024/ND-CP, which was recently issued on May 9, 2024; it adds some new content related to data sharing to suit the implementation situation in the recent past. Through this, the draft Decree details three contents that the Law on Electronic Transactions 2023 assigned the Government to regulate in detail:
Regarding the content on building, updating, maintaining, and exploiting the national database : This Decree transmits the entire content and replaces Decree No. 47/2024/ND-CP, which was recently issued by the Government on May 9, 2024, due to changes in the legal basis when the Law on Electronic Transactions comes into effect on July 1, 2024.
Regarding data connectivity and sharing : Decree No. 47/2020/ND-CP dated April 9, 2020, issued by the Government, has fully regulated data connectivity and sharing. Therefore, this Decree adds provisions on electronic transactions through data connectivity and sharing to facilitate interoperability between agencies; clarifies the intermediary system in data connectivity and sharing; and defines the concept of the National Digital Master Architecture Framework mentioned in the 2023 Law on Electronic Transactions.
Regarding open data content : Decree No. 47/2020/ND-CP dated April 9, 2020, issued by the Government, has provided a comprehensive set of regulations on open data. Therefore, this Decree will refer to existing regulations; and add provisions on the conditions for ensuring the implementation of open data regulations, which are detailed in the Law on Electronic Transactions 2023.
Regulations on standards for data connection and sharing.
Data standards include fundamental data standards in information technology and data structure standards that define the content and information of data. Currently, not many data types have established data structure standards, including: population data, land data, insurance data, and civil servant data. Therefore, the Ministry of Information and Communications is tasked with leading and developing general data and information technology standards to guide ministries, sectors, and localities in developing their own data standards. Based on these, ministries, sectors, and localities are responsible for developing data structure standards within their respective sectors, fields, and databases.
To promote the development and improvement of data standards, the Ministry of Information and Communications has also issued guidance document No. 1016/BTTTT-CĐSQG to ministries, sectors, and localities, providing guidance on the development and application of regulations, standards, and technical specifications for data connectivity and sharing.
However, data structure standards in specialized fields, issued by ministries, departments, and localities, remain limited and incomplete. Only a few basic data types have been developed, and the methods for issuing data structure standards are not yet standardized. Therefore, each ministry and department needs to develop data standards within its sector to clearly distinguish which data should be developed by the central government and which by the local government, according to unified standards. Based on these specialized data standards, the database owner will develop technical regulations for sharing data externally.
