The Ministry of Information and Communications has proactively researched and proposed amendments and supplements to regulations on online advertising management, especially in the draft Law amending and supplementing the Law on Advertising. Including: Specific responsibilities of domestic and foreign advertising platforms; Regulations on administrative sanctions for cross-border advertising platforms that do not comply with advertising regulations in Vietnam; Responsibilities of artists and KOLs when advertising; Advertising management responsibilities of specialized ministries and localities;...

The Ministry of Information and Communications has also deployed technical systems to scan and handle advertising violations, especially videos with harmful content. Solutions include the use of AI technology combined with human resources to proactively censor advertising content, ensuring compliance with Vietnamese laws.

In addition, the Ministry of Information and Communications requires advertising agencies, brands, and publishers to proactively review the content and placement of advertisements. These units are not allowed to cooperate with websites, channels, or accounts that violate the law.

In 2024, the Ministry of Information and Communications will launch the "White List" initiative, a list of websites, channels and accounts with clean and law-compliant content. Advertising dollars will be redirected from cross-border platforms to domestic digital content platforms. The list has been expanded from 7,028 to nearly 8,000 pages/channels/accounts, to promote healthy advertising that is beneficial to the community.

The Ministry of Information and Communications has closely coordinated with the Ministry of Culture, Sports and Tourism, the Ministry of Public Security, as well as other relevant agencies, to issue coordination regulations on restricting the appearance of artists and celebrities who violate the law and negatively affect public morality on social media platforms, in the press and at performance events.

In 2024, the Ministry of Information and Communications conducted inspections of advertising service businesses and penalized many violations. While in 2023, 10 cases were handled with a total fine of VND 175 million, in 2024, the Ministry handled 6 cases with a total fine of VND 130 million. These sanctions have contributed to reducing violations in the field of online advertising.

Despite some successes, online advertising regulation still faces a number of challenges. Cross-border advertising platforms are constantly changing their algorithms and ad distribution methods, making it difficult to scan and detect violations. Violators are also becoming more sophisticated, taking advantage of technology to hide and using anonymous accounts to place illegal ads.

In addition, the current legal system is still not adequate to handle all common violations. Sanctions against cross-border platforms are also not strong enough to deter, leading to some platforms still not complying with Vietnamese laws.

The Ministry of Information and Communications has been implementing many drastic solutions to manage advertising in cyberspace, in order to protect public interests and ensure a healthy advertising environment. Despite significant progress, online advertising management still needs to be further improved in terms of law and technology, and requires close coordination between authorities and cross-border platforms./.
