According to the report of the Ministry of Health on the results of the peak month of the fight against smuggling, trade fraud, counterfeit goods, and intellectual property infringement according to Official Dispatch No. 65/CD-TTg dated May 15, 2025 of the Prime Minister, the Ministry of Health held 2 conferences to disseminate the Prime Minister's direction on this work.

The Ministry of Health has affirmed its guiding viewpoint: resolutely fight without compromise, handle strictly, no forbidden zones, no exceptions. In particular, the Ministry also emphasized the responsibility of individuals and organizations in lax management or abetting violations.
Special working groups led by the Deputy Minister of Health have been established, mobilizing the coordination of departments, offices and localities to enhance the effectiveness of inspection and handling in the field.
Along with that, the Ministry of Health and related departments and agencies have issued many directives and management documents related to the fight to prevent and repel smuggling, trade fraud, counterfeit goods, and intellectual property infringement in the medical field.
The Ministry of Health has also deployed Working Groups led by the Ministry's leaders to work with the People's Committees of 4 provinces and cities: Can Tho , Khanh Hoa, Thanh Hoa and Da Nang.
At the same time, the Ministry of Health sent officials to join the working delegations of Steering Committee 389, working in the provinces and cities: Ho Chi Minh City, Binh Duong, Dong Nai and Ba Ria - Vung Tau, An Giang, Tay Ninh, Lang Son.
The results of inspection and supervision of the implementation of Official Dispatch No. 65/CD-TTg in localities show that localities have resolutely implemented Official Dispatch No. 65/CD-TTg, issued Implementation Plans, and established Inspection Teams for production and business establishments.
Regarding specific areas, such as food safety, the Food Safety Department issued Decision No. 250/QD-ATTP dated May 22, 2025 on the establishment of 5 surprise inspection teams to inspect the implementation of legal regulations on food safety at establishments producing, exporting, importing, and trading food ingredients, milk, and functional foods in 5 provinces/cities: Bac Ninh, Thai Binh, Dong Nai, Nam Dinh, and Hanoi.
The inspection teams conducted surprise inspections of 17 establishments producing and trading functional foods. Through the inspection, 1 establishment was found to have violated the mandatory content on the product label (a Notice was issued requesting temporary suspension of the circulation of goods); 2 establishments violated advertising; 1 establishment violated 4 acts regarding conditions in production and trading. At the same time, the Food Safety Department sent a document to the provincial/municipal Finance Department requesting the revocation of the Business Registration Certificates of 4 food business establishments.
The inspection teams have taken samples for testing but so far there are no test results. After the test results are available, the inspection teams will continue to advise on handling administrative violations against violating establishments.
Regarding the pharmaceutical and cosmetic sector, the Drug Administration of Vietnam issued Decision No. 610/QD-QLD dated May 20, 2025, establishing 5 inspection teams to conduct surprise inspections in provinces and cities including Hanoi, Ho Chi Minh City, Dong Nai, Binh Duong, Long An, An Giang, Nam Dinh, Phu Tho, Bac Ninh, inspecting 38 establishments, of which 18 are in the pharmaceutical sector (9 manufacturing establishments; 9 drug importing establishments); 20 cosmetic trading establishments (including 13 cosmetic manufacturing establishments, 7 cosmetic trading and declaration establishments).
During the inspection, the inspection team discovered 17 establishments with administrative violations. The Drug Administration Department has forwarded the information of the violations to the competent authorities for handling according to their authority. Specifically: In the pharmaceutical field, 7 establishments committed administrative violations, including 2 pharmaceutical trading establishments and 5 drug manufacturing establishments.
The Inspection Teams of the Drug Administration Department advised the Department's Leaders to issue a document to temporarily suspend production for 1 facility because it only met GMP level 4 principles; requested to destroy 841 Milgamma N tubes that did not meet sensory quality standards (due to the hospital not preserving them properly according to the conditions stated on the label and returning them to the Company) and 2 batches of semi-finished products used to produce health protection foods because they did not meet the preservation conditions; recommended the competent authority (the Department of Traditional Medicine Administration) to review the scope of the GMP certificate of 1 unit because at the time of inspection, the traditional medicine production line had not been operating for a long time and did not have enough equipment as at the time of assessment.
In the cosmetics sector, 9 establishments committed administrative violations, the main violations being the acts of declaring, advertising, producing, and trading cosmetics with ingredients that do not match the Cosmetic Product Declaration Form.
Inspecting 37 units in the field of medicinal herbs, traditional medicines, traditional medicinal ingredients and medical equipment: The Department of Traditional Medicine and Pharmacy Management has issued the following Decisions: Decision No. 171/QD-QLD dated May 20, 2025 establishing an inspection team in Hanoi city; Decision No. 172/QD-QLD dated May 22, 2025 establishing an inspection team in Ho Chi Minh City and Binh Duong province; Decision No. 186/QD-QLD dated June 3, 2025 establishing an inspection team in Hung Yen province.
The inspection teams conducted surprise inspections at 21 establishments, including 5 manufacturing establishments, 3 hospitals, 10 traditional medicine clinics, traditional medicine clinics, 1 wholesale establishment, 2 retail establishments of medicinal herbs, herbal medicines, and traditional medicines. Thereby, 4 establishments were found to have committed administrative violations and the information was transferred to the Department of Health to handle the violations.
Regarding the field of medical equipment, the Department of Infrastructure and Medical Equipment issued Decision No. 17/QD-BYT dated May 23, 2025, on the establishment of a Working Group of the Department of Infrastructure and Medical Equipment on the peak month of the fight against and repelling crimes of smuggling, trade fraud, and counterfeit goods; Decision No. 18/QD-HTTB dated May 23, 2025 on the establishment of surprise inspection teams to prevent and repel smuggling, trade fraud, and counterfeit goods under the direction of the Prime Minister; Plan No. 439/KH-HTTB dated May 31, 2025 on the deployment of 3 inspection teams to implement legal provisions on medical equipment.
Inspection teams from the Department of Infrastructure and Medical Equipment conducted surprise inspections at 16 medical examination and treatment facilities, medical equipment manufacturing and trading establishments in the provinces and cities of Hanoi, Can Tho and Ho Chi Minh City.
Through the inspection, no units with violations were detected. The Department of Infrastructure and Medical Equipment has transferred the Inspection Minutes with related documents for 14 inspected units to the Department of Health of Hanoi, Ho Chi Minh City, and Can Tho to implement the conclusions of the inspection team.
