On the afternoon of June 5, at a press conference on the socio -economic situation of Ho Chi Minh City, a representative of the Market Management Department (QLTT), Ho Chi Minh City Department of Industry and Trade, informed about the incident related to J97 Entertainment Company Limited - the company of singer Jack-J97). Accordingly, this company advertised the lightstick product for sale at 997,000 VND/piece, but consumers reported that it had not delivered the goods as promised.

According to the Market Management Department, the act of a business directly producing or ordering processing, then advertising and selling lightstick products for profit is considered a commercial business activity under the provisions of the 2005 Commercial Law. In this case, Lightstick is determined to be a type of commodity.

"To operate legally, J97 Entertainment Company is required to register its business, declare taxes and fulfill all financial obligations as prescribed," said a representative of the Market Management Department.

Regarding online sales, the authorities said that if using a website with online ordering and payment functions, the company must notify the Ministry of Industry and Trade of the e-commerce sales website according to Decree 52/2013/ND-CP, amended by Decree 85/2021/ND-CP.

"Selling goods through social networking platforms such as Facebook, Instagram... is also considered e-commerce. Therefore, sellers must still fully comply with regulations on product information, tax obligations and responsibilities to consumers," added a representative of the Market Management Department.

Regarding the reflection that about 3,600 people have ordered products with a total amount of about 3.6 billion VND but have not received the goods, the Ho Chi Minh City Market Management Department emphasized that the unit does not have the authority to determine whether the behavior has signs of criminality. Determining whether there are signs of fraud and property appropriation or not is under the authority of the investigation agency, the prosecutor's office and the court.

According to the representative of the Market Management Department, in case consumers do not receive the goods or are not refunded, they can file a complaint with the police if they suspect a criminal violation. In addition, consumers can also file a lawsuit in the People's Court to request the company to deliver the goods, refund or compensate for damages.

At the same time, submit a petition to the Department of Competition and Consumer Protection (Ministry of Industry and Trade) or the local Department of Industry and Trade for consideration and dispute resolution in accordance with the provisions of the Law on Consumer Protection, in case there are signs of administrative violations.

Regarding the role of singer Jack – J97 in the incident, the Ho Chi Minh City Market Management Department said that if there is sufficient evidence to show that the image representative has violated criminal law, the competent authorities will consider handling it according to regulations.
