Implementing the provisions of law in mineral exploitation activities in Quang Binh province, in recent years, organizations and individuals operating in mineral exploitation in the province have made many efforts to invest in modern machinery and equipment to serve exploitation and maintain production. Many units have well implemented the provisions of law in mineral exploitation activities and environmental protection.
However, there are still some units, organizations and individuals taking advantage of the Covid-19 epidemic to illegally exploit and violate the provisions of the law on mineral exploitation and environmental protection. Through inspection and examination, organizations and individuals who violate the law have been discovered and handled, some of which have been so serious that they must be prosecuted, affecting the environment and security and order in the area.
To effectively implement the provisions of the law on minerals, the Department of Natural Resources and Environment requires organizations and individuals that have been granted a valid mineral exploitation license in the province to continue to strictly comply with the provisions of the law on minerals and the guiding documents for law enforcement of all levels of government.
Specifically, protect the boundary markers and mine boundaries (including deposit markers and buoy markers for areas where markers cannot be placed), absolutely do not exploit outside the scope and boundary of the permitted mining area or exploit beyond the permitted depth limit; organize management and protection, and do not allow illegal mineral activities to occur within the assigned management scope and adjacent areas; when detecting illegal mining activities, immediately report to the People's Committee of the commune or district where the mine is located, or the Department of Natural Resources and Environment for timely inspection and handling.
Exploitation must comply with the approved design, technology, and exploitation plan; fully declare the actual mineral output, carry out statistics and inventory of mineral reserves according to regulations; for sand and gravel exploitation on riverbeds, it is necessary to register and inspect vehicles, ships, and boats, attach license plates to ships, vehicle owners, exploitation registration units, and contracts for exploitation, transportation, installation, management, and operation of journey monitoring equipment and storage of data and information on the location and travel route of vehicles and equipment used for sand and gravel exploitation and transportation according to regulations at Point b, Clause 2, Article 9 of Decree No. 23/2020/ND-CP dated February 24, 2020 of the Government regulating the management of sand and gravel on riverbeds and protection of riverbeds, banks, and beaches.
Fully implement the installation of weighing stations and cameras at the yard and warehouse to monitor and store information and data related to the volume of minerals exploited and sold according to the provisions of Article 42 of Decree 158/2016/ND-CP dated November 29, 2016 of the Government detailing a number of articles of the Law on Minerals.
Conducting measurements to create maps and cross-section drawings of current status; preparing records, books and documents to determine actual mineral output as prescribed in Circular No. 17/2020/TT-BTNMT dated December 24, 2020 of the Ministry of Natural Resources and Environment regulating the creation of maps and cross-section drawings of current status of areas permitted for exploitation, statistics and inventory of exploited mineral reserves and processes, methods and forms to determine actual mining output (in case organizations and individuals cannot do it, they must hire consultants with sufficient legal status as prescribed).
Restore the boundary markers of the mine area and the main geodetic markers (if lost) established during the process of mineral exploration and basic construction of the mine, and be responsible for protecting the stable markers throughout the exploitation period to serve the purpose of inspection and supervision.
Exploitation must be in accordance with the approved investment project, specifically: exploitation must be in accordance with the design, location, depth, and permitted capacity. At the same time, fully implement environmental protection measures committed to in the environmental impact assessment report or environmental protection plan and approved environmental restoration plan; Report on the proposed environmental license of the facility to the competent licensing authority according to regulations.
