The awarding of the Medal of Honor must be public, democratic, objective, fair, and timely in accordance with the provisions of law. The organization of the awarding of the Medal of Honor must be solemn, economical, effective, and without ostentation or formality.
Subjects and criteria for awarding Commemorative Medals to individuals who have worked or are working in the Judiciary sector
1. Minister, Deputy Minister of Justice ; former Minister, Deputy Minister of Justice.
2. Leaders of units under the Ministry of Justice, advisory and support agencies of the Party Committee of the Ministry, socio -political organizations under the Ministry of Justice, Department of Justice, Civil Judgment Enforcement of provinces and cities:
- Individuals working in the Judiciary sector are appointed as heads of units under the Ministry, advisory and support agencies of the Party Committee of the Ministry, socio-political organizations under the Ministry, Departments of Justice, Civil Judgment Enforcement of provinces and cities with a total time holding the position of 05 years or more for men, 03 years or more for women; are appointed to hold the position of deputy head with a total time holding the position of 08 years or more for men, 06 years or more for women and have completed their tasks well or better during the period of time which is a condition for consideration for award.
- In case an individual working in other sectors is transferred to the Judiciary sector to be appointed as the head or deputy head of a unit under the Ministry, the advisory and support agency of the Party Committee of the Ministry, the socio-political organization under the Ministry, the Department of Justice, the Civil Judgment Enforcement of provinces and cities, with a total time holding a head position in the Judiciary sector of 06 years or more for men, 04 years or more for women; with a total time holding a deputy position in the Judiciary sector of 09 years or more for men, 07 years or more for women and completing the task well or better during the period is a condition for consideration for awarding.
- In case an individual has held a senior position as prescribed in Point a and Point b of this Article but does not have enough time to propose an award according to the prescribed standards for that position, the time held as a deputy position shall be added to the proposal for awarding a Commemorative Medal according to the deputy position.
3. Individuals working at units under the Ministry of Justice, advisory and support agencies of the Party Committee of the Ministry, socio-political organizations under the Ministry of Justice, Departments of Justice, Civil Judgment Enforcement of provinces and cities and Justice - Civil Status Officials are proposed to be awarded the Medal when they have a total working time of 20 years or more for men, 15 years or more for women and have completed their tasks well or better during the time that is the condition for awarding.
4. Individuals working in other sectors and organizations and transferring to the Judiciary sector or transferring from the Judiciary sector to other sectors and organizations are proposed for consideration for the Medal of Honor when they have a total working time of 25 years or more for men, and 20 years or more for women, including a total working time in the Judiciary sector of 12 years or more and have completed their tasks well or better during the period that is the condition for consideration for the award.
5. Individuals working in the Judiciary sector, if the time required for award consideration is less than 12 months compared to the regulations, will be considered for awarding the Medal before retirement.
Subjects and criteria for awarding Commemorative Medals to individuals working in the judicial sector
1. Individuals directly engaged in legal work at Ministries, ministerial-level agencies, Government agencies, specialized agencies under the People's Committees of provinces and cities, state-owned enterprises under the Ministries and branches at the Central level; Judicial appraisers; individuals directly engaged in civil judgment enforcement work in the Army are proposed to be awarded the Commemorative Medal when they have a total time of working in the judiciary of 22 years or more for men, 17 years or more for women and have completed their tasks well or better within the time period that is the condition for awarding.
2. Individuals who are lawyers; notaries working at Notary Offices; Auctioneers working at property auction enterprises; Bailiffs; Administrators; Arbitrators; Commercial Mediators are proposed to be awarded the Medal when their total working or practicing time is at least 22 years for men, and at least 17 years for women.
Subjects and criteria for awarding Commemorative Medals to other individuals with meritorious contributions to the development of the Judiciary sector
1. Individuals holding leadership positions with contributions to the development of the Judiciary sector are proposed for consideration for the award of the Commemorative Medal:
Heads and deputy heads of Central Party Committees, the Office of the National Assembly, agencies under the National Assembly Standing Committee, the Office of the President, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, ministries, ministerial-level agencies, and agencies under the Government; members of the Standing Committee of the Central Committee of the Vietnam Fatherland Front and the Standing Committee of socio-political organizations under the Central Committee of the Vietnam Fatherland Front.
Secretary, Deputy Secretary of Provincial Party Committee, City Party Committee; Chairman, Vice Chairman of People's Council, People's Committee, Chairman of Vietnam Fatherland Front Committee of province, city.
2. Individuals who are members of the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level; Directors, Deputy Directors of departments, branches, sectors and equivalent at the provincial level, have directly led and directed the implementation of tasks under the management authority of the Ministry of Justice for at least 07 consecutive years for male heads, at least 05 consecutive years for female heads; at least 10 consecutive years for male deputies, at least 08 consecutive years for female deputies.
3. Individuals who are Vietnamese people living abroad, Vietnamese people living in the country but working for foreign diplomatic and consular agencies or international organizations in Vietnam; foreigners are proposed to be awarded the Medal when they have made outstanding contributions and achievements in building and strengthening cooperative relationships between those countries, agencies and organizations with the Ministry of Justice, actively contributing to the cause of building and developing the Justice sector.
4. Other cases as decided by the Minister of Justice.
Cases that have not been considered for awarding, and are not considered for awarding the Commemorative Medal
1. Not proposing to award a Commemorative Medal to an individual during the time the competent authority is considering disciplinary action or investigating, inspecting, or checking when there are signs of violations or there are complaints, denunciations, or corruption or negative issues reported by the press that are being verified and clarified.
2. Disciplinary period and working period assessed as below satisfactory performance will not be counted for consideration of awarding the Commemorative Medal.
3. Individuals are not eligible for the Commemorative Medal if they are subject to disciplinary action at the level of forced dismissal or expulsion from the Party.
The awarding of the Medal is conducted annually on the occasion of the anniversary of the Traditional Day of the Vietnamese Judiciary or on an ad hoc basis according to the decision of the Minister of Justice. Individuals awarded the Medal will receive a reward in kind, a frame and a bonus equal to 0.4 times the basic salary.
