Faced with new requirements from the two-level local government model, especially in areas that directly affect people and businesses such as land, the Department of Land Management ( Ministry of Agriculture and Environment ) has issued a "Handbook on State management in the field of land when implementing two-level local government" with many necessary contents.

Most notable are the regulations on the order and procedures for granting and exchanging certificates of land use rights and ownership of assets attached to land (red books).

“3-step” process of issuing red book

Specifically, Deputy Director of the Department of Land Management - Ms. Doan Thi Thanh My emphasized that the above handbook is a practical document to help localities clearly understand regulations, authorities, and procedures, thereby effectively implementing tasks according to decentralization, delegation of authority, and new authority assignment; helping people better understand administrative procedures for more convenient implementation.

The handbook provides specific instructions on the registration and issuance of land use right certificates and ownership of assets attached to land for the first time for households, individuals, residential communities, and people of Vietnamese origin residing abroad, including 3 steps, clearly assigning responsibilities between state agencies and people.

Specifically, those who need to register submit their application at the Public Administration Service Center. They can submit a copy with the original for comparison, submit a notarized or certified copy, or submit online if the application has been digitized. If a copy is submitted, the original must be presented upon receiving the results. This is step 1.

Step 2: After receiving the application, the agency handling the procedure checks the application components, issues a notice of appointment to return the results or requests additional information if there is anything missing. The application is then transferred to the People's Committee of the commune where the land is located for verification.

On that basis, the People's Committee at the commune level is responsible for extracting or measuring the cadastral map, confirming the current status of land use, dispute status, compliance with planning, land use origin (if there are no documents); publicly posting the review results at the headquarters and residential areas within 15 days, checking whether or not the conditions are met to be granted a red book according to the provisions of the law on land.

In case people have the need and are eligible for a red book, the commune-level People's Committee will send a transfer of information to determine financial obligations regarding land to the tax authority so that the tax authority can determine and notify the collection of financial obligations for land users and owners of assets attached to the land.

Step three, after receiving the tax authority's notice of completion of financial obligations or being recorded as having a financial obligation in debt, the chairman of the commune-level People's Committee issues the red book and transfers the red book to the dossier receiving agency to give to the people.

The time for processing procedures is significantly shortened, for first-time land registration no more than 17 working days. For land registration with red book issuance no more than 20 working days. For mountainous areas, islands, remote areas or areas with particularly difficult socio -economic conditions, the time is extended to a maximum of 30 working days.

No need to edit the red book

In a related development, responding to recent voters' petitions, Minister of Agriculture and Environment Do Duc Duy said that the ministry has sent documents to localities to guide the adjustment of cadastral records, land databases and collection of natural area data in the process of restructuring the apparatus.

The Ministry of Agriculture and Environment has also recommended that localities have solutions to direct the settlement of land administrative procedures for people when implementing the two-level local government organization model quickly.

Giving an example, Mr. Duy said that with the issuance of land use right certificates, if previously the certificate was issued by the city level, the place name could be written as Minh Bao commune, Yen Bai city, but now Minh Bao commune no longer exists, then people still do not need to make any adjustments.

The reason is because the documents are still fully legally valid and do not need to be changed, unless people carry out procedures such as separation or transfer.

In cases like the above, according to Mr. Duy, the state agency will both carry out administrative procedures and adjust according to the new administrative boundaries, update data, and new plots. Therefore, people can be completely assured, not having to bring red books, pink books to adjust just because of the change of administrative unit name./.

According to Article 5 of Decree No. 151/2025/ND-CP of the Government on the division of authority between two-level local authorities in the field of land, from July 1, 2025, people can choose to submit land registration applications at any unit in the same province or city, instead of only submitting at the place where the land is located as before.
