The provincial level decides on the selection of the head of the organization.
Minister of Home Affairs Pham Thi Thanh Tra, Deputy Head of the Standing Committee of the Steering Committee for the reorganization of administrative units at all levels and the construction of a two-tiered local government organizational model, has just signed a document sent to localities providing guidance on the implementation of tasks related to the reorganization of administrative units.
In this document, the Steering Committee clearly outlines the direction for arranging and assigning new provincial and commune-level officials and civil servants after the merger.

Specifically: The arrangement and placement of officials and civil servants holding leadership and management positions at the provincial level after the restructuring will be carried out in accordance with the Politburo 's Conclusion and the Central Organization Committee's guidelines.
The number of leaders and managers in the newly reorganized provincial-level agencies and organizations shall not exceed the total number of leaders and managers present in the provincial-level organizations before the reorganization.
For cases where an individual currently holds the position of head of a specialized agency, based on practical conditions and the standards and capabilities of the officials and civil servants, the Standing Committee of the Provincial People's Committee shall consider and decide on the selection of a new head who meets the requirements of the new unit after the reorganization.
For heads of specialized agencies who are not reassigned to the position after the reorganization, they may be assigned to the next lower-level position or to an equivalent position in another agency, organization, or unit, or be seconded to a leadership role at the commune level as required by the task.
These individuals are entitled to retain their position allowance as per regulations.
For individuals currently holding the position of deputy head of a specialized agency, the Standing Committee of the Provincial People's Committee shall consider and decide on their appointment as deputy head of the unit after restructuring, or assign them to an equivalent position in another agency or organization, or reinforce them to a leadership position at the commune level.
The Steering Committee has allowed that, for the time being, the number of deputy heads of agencies, organizations, and units at the provincial level after the restructuring may be higher than the regulations, and will gradually decrease according to the roadmap.
Similarly, the current number of civil servants, public employees, and contract workers will be maintained for the time being to arrange and assign tasks. Subsequently, downsizing will be implemented in conjunction with restructuring and improving the quality of the workforce according to a roadmap, ensuring that within 5 years, the number of personnel will essentially comply with regulations.
The leadership standards at the commune level are the same as those at the district level currently.
The official document signed by the Minister of Home Affairs also clarifies that the standards for leadership and management positions at the commune level will be the same as those currently applied to the corresponding leadership and management positions at the district level.
"For professional and technical civil servants at the commune level, the training qualification standards for job positions applicable to civil servants and public employees at the district level and above, as stipulated by the Government , shall be applied," the document sent to localities clearly states.
According to the Steering Committee, based on practical conditions and the current standards and capabilities of officials and civil servants at the district and commune levels, the Standing Committee and the Provincial People's Committee will consider and decide on the arrangement and placement of officials and civil servants at the new commune level according to the decentralized management system.
Officials and employees at the district and commune levels, upon being appointed to leadership and management positions at the commune level, will continue to receive their current leadership allowance for a period of 6 months from the date of the decision. After this period, they will be subject to the new regulations of the Government.
"In cases where civil servants and professional staff are appointed to leadership and management positions at the commune level, the leadership allowance will not be applied temporarily and will be implemented when the Government issues regulations on the coefficient for that leadership and management allowance," the Steering Committee stated.
