Stricter penalties for spam messages and calls.

Messages containing fake links, spam calls, or malware remain common tactics used by malicious actors to reach users online. Current laws stipulate various penalties for these actions to ensure information security and protect the rights of telecommunications service users.

Recently, the methods of distributing spam messages, spam calls, and fake links have continued to become more complex. Many perpetrators use messages containing fake links impersonating agencies and organizations to trick users into providing personal information, OTP codes, and account data. In addition, missed calls from unknown numbers aimed at tricking users into calling back, spreading malware, or advertising illegally continue to cause significant inconvenience and pose a potential information security risk to telecommunications service users.

According to point b, clause 6, Article 94 of Decree 15/2020/ND-CP, as amended by clause 32, Article 1 of Decree 14/2022/ND-CP, the act of sending or distributing spam emails, spam messages, malware, or making spam calls may be subject to a fine of VND 60 million to VND 80 million.

In addition, the act of creating a large number of missed calls to trick users into calling back for profit, exploiting telecommunications subscriptions for improper purposes, or using messaging systems to facilitate fraudulent activities are also subject to severe penalties.

For businesses providing services, the penalties are even more severe. According to Clause 4, Article 95 of Decree 15/2020/ND-CP, amended by Clause 33, Article 1 of Decree 14/2022/ND-CP, businesses that fail to build a technical system to block spam messages and calls, fail to implement anti-spam measures, or fail to block the source of dissemination may be fined from VND 140 million to VND 170 million.

At the same time, according to Clause 5, Article 95 of Decree 15/2020/ND-CP, amended by Decree 14/2022/ND-CP, violating businesses may also have their service provision activities suspended for 1 to 3 months. In addition to fines, many remedial measures are also applied, such as forcing the withdrawal of the identifying name, forcing the withdrawal of the infringing phone number, or suspending the service provision activities.

Notably, these violations not only face the risk of administrative penalties but may also result in criminal prosecution if the elements constituting a crime are present.
