The Ministry of Education and Training has just issued Circular No. 15 dated July 24th, guiding the functions, tasks, and powers of the Department of Education and Training and the Culture and Social Affairs Department under the People's Committee at the commune level.

The Department of Education and Training is responsible for the recruitment, acceptance, assignment, secondment, and transfer of the teaching staff.

According to the circular, the Department of Education and Training has the right to decide on the establishment of school boards, recognize, appoint, and dismiss the chairman of the school board, add and replace members of the school board, and decide on the recognition, appointment, reappointment, extension of service until retirement age, termination of office, dismissal, change of job position, commendation, and disciplinary action against the heads and deputy heads of public educational institutions under its management authority.
Recognizing, supplementing, and consolidating school councils and boards of directors; recognizing, dismissing, removing, and replacing the chairman, vice-chairman, principal, and vice-principal of the school council; replacing the chairman, secretary, and members of the board of directors; or terminating the activities of the board of directors of private educational institutions under its management authority, in accordance with the job title standards and procedures prescribed by law.
Decision on the appointment of heads and deputy heads of public educational institutions under the state management of two or more commune-level administrative units.
The Department of Education and Training is also tasked with presiding over the implementation, in accordance with the Law on Teachers, relevant legal regulations, and the decentralization of the Provincial People's Committee, of the recruitment, acceptance, assignment, secondment, and transfer of teachers, educational administrators, civil servants, and employees in public educational institutions within the province.
Preside over the management, utilization, changes in professional titles, training, professional development, and evaluation of teachers, educational administrators, civil servants, and employees in public educational institutions within the province, in accordance with the decentralization of the provincial People's Committee and the provisions of the Law on Teachers.
The Department of Education and Training decides, according to the delegated authority, or submits to the Chairman of the Provincial People's Committee for approval, the job positions, adjustments to job positions, and the structure of civil servants according to professional titles in public educational institutions under its management; and manages job positions, civil servants according to professional titles, and the number of employees in educational institutions in the province.
Ensuring sufficient staffing of civil servants in education management, a sufficient number of employees receiving salaries from the state budget, and the number of labor contracts according to the approved job position plan; meeting the conditions for ensuring educational quality; being accountable for educational activities, educational quality, managing staff, workers, and students; and implementing educational development policies within their management authority.
The decision to allocate and adjust the number of salaried employees from the state budget to public educational institutions in the province is based on the total number of employees approved by the provincial People's Council as stipulated.
The Department of Education and Training is also responsible for deciding, within its delegated authority, or submitting to the Chairman of the Provincial People's Committee for decision, on regular salary increases, early salary increases, and other salary, allowance, bonus, and other benefits and policies for civil servants and contract workers in educational institutions under its management authority, in accordance with the law and the regulations of the Provincial People's Committee.
