The Ministry of Industry and Trade has issued Circular 09/2023/TT-BCT amending and supplementing a number of Circulars regulating the implementation of electricity prices. Circular 09/2023/TT-BCT has amended and supplemented a number of notable contents.
First, how to identify the household electricity buyer with households using the same electricity meter.
According to the provisions of Clause 2, Article 10 of Circular 16/2014/TT-BCT, the determination of the household electricity buyer with households using the same meter will be based on the household registration.
However, according to the new regulations in Circular 09/2023/TT-BCT, determining the household electricity buyer with households using electricity using the same meter will be determined based on the information on the residence of the household at the location of electricity use.
For households using electricity using the same meter, the electricity price applied to the households using electricity is based on the principle that the common rate of the electricity buyer is equal to the rate of each level multiplied by the number of households using electricity using the same meter.
Second, the method of determining the electricity buyer for domestic use in collective housing can be determined by the number of people.
According to the provisions of Point a, Clause 3, Article 10 of Circular 16/2014/TT-BCT, the electricity buyer uses for domestic purposes for collective housing of cadres, civil servants, armed forces, housing of monks and nuns; student dormitories, the following shall apply: "In case the number of people can be declared, every 4 people (based on the temporary residence book or list of cadres and soldiers with confirmation from the unit head for armed forces) shall be counted as one household using electricity to apply the retail price of household electricity".
Thus, the method of determining the electricity buyer for domestic purposes for collective housing in cases where the number of people can be declared will be based on the temporary residence book or the list of officers and soldiers with confirmation from the unit head for the armed forces.
However, according to the new regulations in Circular 09/2023/TT-BCT, the determination of the electricity buyer for domestic use for collective housing in cases where the number of people can be declared will be based on information on residence at the location of electricity use or the list of officers and soldiers with confirmation from the unit head for the armed forces.
Accordingly, the retail price of household electricity for the electricity buyer using for household purposes for collective housing in this case is considered as one household using electricity to apply the retail price of household electricity.
Third, in addition to the case of new electricity supply for domestic purposes, change of the subject of the electricity purchase and sale contract, termination of the electricity purchase and sale contract, change of the date of recording the meter index determined based on the agreement with the electricity customer, the electricity usage level of each level is adjusted according to the actual number of days of that meter index recording period.
Fourth, amend the regulations on retail electricity prices for students and workers renting houses (the tenant is not a household).
Specifically, in the case where the tenant has a rental contract of 12 months or more and has registered temporary or permanent residence (determined based on information about residence at the location of electricity use), the landlord directly signs the electricity purchase contract or the tenant's representative signs the electricity purchase contract (with the landlord's commitment to pay the electricity bill).
In case the rental period is less than 12 months and the landlord cannot fully declare the number of electricity users, the retail price of household electricity of level 3 will be applied: From 101 - 200 kWh for the entire electricity output measured at the meter.
In case the homeowner fully declares the number of people using electricity, the electricity seller is responsible for providing the quota to the homeowner based on the information about residence at the place of electricity use; every 4 people are counted as one household using electricity to calculate the quota applied to the retail price of household electricity, specifically: one person is counted as 1/4 of the quota, 2 people are counted as 1/2 of the quota, 3 people are counted as 3/4 of the quota, 4 people are counted as one quota.
When there is a change in the number of tenants, the landlord is responsible for notifying the electricity seller to adjust the electricity bill calculation.
Fifth, the electricity seller is allowed to request the electricity buyer to provide information about the residence at the location of electricity use as a basis for determining the number of people to calculate the electricity bill.
