In the context of implementing the two-level local government model, the effective implementation of legal dissemination, education, mediation at the grassroots level and the implementation of legal access standards play an important role in ensuring the rights and obligations of the people and improving the effectiveness and efficiency of state management at the grassroots level. Based on the guidance of the Ministry of Justice , on July 22, 2025, the Department of Justice issued Official Dispatch No. 2319/STP-PBGDPL on guiding the implementation of legal dissemination, education, and mediation at the grassroots level in Ca Mau province, accordingly requesting the People's Committees of communes and wards to urgently implement a number of key contents in the last 6 months of 2025 to improve the quality of the team, ensure operating conditions and allocate appropriate resources to meet the requirements in the new period specifically:
- Request the People's Committees of communes and wards to develop an implementation plan for the last 6 months of 2025. The plan needs to clearly define: objectives, content, implementation time; specific assignment of each task; funding, implementation sources.
- Review and improve the team of legal propagandists: Based on the team of district-level legal reporters (old) assigned to work at the commune level and the commune's legal propagandists, the People's Committee at the commune level reviews, evaluates and improves the team of legal propagandists. Pursuant to Article 37 of the Law on Dissemination and Education of Law, the Chairman of the People's Committee at the commune level decides to recognize legal propagandists, ensuring that there are enough resources to carry out the work of disseminating and educating the law in the area.
- Strengthening mediation work at the grassroots level: According to the current general policy, hamlets, residential groups in the (new) commune-level administrative units will remain unchanged until there are new regulations from the Government . Therefore, mediation teams in the old hamlets and residential groups will continue to carry out mediation tasks in the area.
To ensure the operating conditions of the mediation team in the coming time, the People's Committee at the commune level shall preside over and coordinate with the Vietnam Fatherland Front Committee at the same level to organize a review and assessment of the operation of the mediation team and mediators at the grassroots level according to the new administrative boundaries. In which, statistics on the current situation of the mediation team in the area: total number of mediation teams, number of mediators, operation situation... Based on the current situation and actual requirements, consider improving the mediation teams with large fluctuations in the team of mediators, not meeting the operating conditions (lack of team leader, number and structure are not guaranteed...). The standards, number and composition of the mediation team shall comply with the provisions of Article 7 and Clause 1, Article 12 of the Law on Mediation at the Grassroots Level 2013. Note: Priority shall be given to selecting people with prestige, expertise and experience in the legal field (such as lawyers, retired police officers, border guards), mobilizing legal propagandists and members of the Security and Order Protection Team to participate in and support mediation work at the grassroots level. The election and appointment of mediators shall comply with the provisions of Article 12 of Joint Resolution No. 01/2014/NQLT/CP-UBTUMTTQVN dated November 18, 2014 of the Government and the Central Committee of the Vietnam Fatherland Front.
Regarding the use of the Mediation Activity Monitoring Book at the grassroots level: Instructions for the Head of the Mediation Team to maintain, preserve and keep the book. When leaving the position, the Head of the Mediation Team must hand over the book to the successor. For the Mediation Teams that have been issued a new Book, close the old book and record the new book according to the new administrative unit. For the case of the Mediation Teams that have not been issued a new Book and are still using the old Book, close the book and open a new page to record according to the new administrative unit to ensure consistency and unity in the monitoring of mediation activities at the grassroots level.
Implementing the Project to improve the capacity of mediators for the period 2024-2030: The People's Committees at the commune level continue to implement tasks in the locality according to the Project issued by the Provincial People's Committee; in which, focusing on specific areas such as ethnic minority areas, coastal areas, and areas with difficult and complicated security and order. Assigning officials to act as focal points to advise and coordinate the effective implementation of the contents of the Project. Reviewing and deciding to recognize the team of mediator trainers at the grassroots level in the locality, ensuring sufficient quantity and composition according to the provisions of Decision No. 315/QD-TTg dated April 17, 2024 of the Prime Minister.
For communes and wards (Ca Mau province before the merger), continue to deploy and direct the good implementation of the model "5 good grassroots mediation teams" (accompanied by the Inter-sectoral Guidelines of the Department of Justice and the Standing Committee of the Vietnam Fatherland Front Committee of Ca Mau province).
To continue to improve the effectiveness of mediation work at the grassroots level, the People's Committees at the commune level pay attention to organizing training and fostering professional skills and mediation skills for mediators. The Department of Justice sends documents to the People's Committees at the commune level, judicial and civil status officials, and mediators at the grassroots level to declare, use, and deploy to mediators for research and use in mediation activities at the grassroots level. - On the implementation of operating expenditure levels for legal dissemination and education, grassroots mediation, and legal access standards
For commune-level units within the administrative boundaries of Ca Mau province (before the merger), Resolution No. 34/2023/NQ-HDND dated December 6, 2023 of the People's Council of Ca Mau province shall apply, stipulating the level of expenditure to ensure the dissemination and education of law, standards of legal access and mediation at the grassroots level in Ca Mau province.
For commune-level units within the administrative boundaries of Bac Lieu province (before the merger), Resolution No. 28/2023/NQ-HDND dated December 8, 2023 of the Bac Lieu Provincial People's Council stipulates the level of expenditure to ensure the dissemination and education of law, standards of legal access and mediation at the grassroots level in Bac Lieu province.
In the coming time, it is necessary to have close attention and direction from local authorities and the active participation of the entire political system so that the work of disseminating and educating the law, mediation at the grassroots level and standards of legal access can truly go into depth, promote practical effectiveness, and contribute to building a disciplined, democratic and sustainably developed society./.
