Facilitate businesses to carry out environmental procedures

Recently, the People's Committee of Da Nang City has decentralized and authorized the Department of Agriculture and Environment and the People's Committees of wards and communes to handle environmental records in order to create favorable conditions for businesses and establishments to implement investment projects, put them into operation or complete legal records on the environment of production, business and service establishments in accordance with the provisions of the Law on Environmental Protection 2020.

In recent years, the Management Board of the High-Tech Park and Industrial Parks of Da Nang has been decentralized and authorized by central ministries, branches, and the City People's Committee to handle many administrative procedures on investment, land, planning, construction, environment, etc.

After the Law on Environmental Protection 2020 comes into effect, the Management Board of Da Nang High-Tech Park and Industrial Parks is authorized to handle records and procedures for appraisal and approval of appraisal results of environmental impact assessment (EIA) reports; grant, change, re-grant, adjust, and revoke environmental licenses, contributing to the effective implementation of the "one-stop, on-site" administrative mechanism, creating favorable conditions for business activities.

Director of Da Nang Industrial Park Infrastructure Development and Exploitation Company Nguyen Trong Cuong acknowledged that decentralization and delegation of authority to handle administrative procedures to localities and shortening environmental procedures in industrial parks have created favorable conditions for investors and businesses to quickly invest in construction and put projects into operation, contributing to the city's socio -economic development. At the same time, it also creates conditions for secondary businesses in industrial parks, especially old businesses lacking environmental records, to complete environmental legal procedures and operate with peace of mind.

According to the Department of Agriculture and Environment, after merging administrative units, the Chairman of the City People's Committee has agreed to authorize the Management Board of the High-Tech Park and Industrial Zones of Da Nang to appraise the EIA report, issue environmental licenses for investment projects and facilities in industrial parks, Da Nang High-Tech Park, Concentrated Information Technology Park, Da Nang Free Trade Zone. Along with that, authorize the Management Board of Quang Nam Economic Zones and Industrial Zones to appraise the EIA report, issue environmental licenses for investment projects and facilities in Chu Lai Open Economic Zone, Nam Giang Border Gate Economic Zone...

For investment projects and facilities located outside the Da Nang High-Tech Park, the Concentrated Information Technology Park, the Da Nang Free Trade Zone, economic zones and industrial parks, depending on the scale of waste generation (wastewater, emissions, hazardous waste) and the risk of environmental pollution according to regulations, the Chairman of the City People's Committee has just issued Decision No. 958/QD-UBND dated August 13, 2025, authorizing the Department of Agriculture and Environment, People's Committees of wards and communes to issue, change, adjust, reissue, and revoke environmental licenses.

In addition, the Department of Agriculture and Environment appraises and approves the results of appraisal of EIA reports for investment projects and facilities; appraises and approves environmental improvement and restoration plans for mineral exploitation projects and facilities according to regulations.

Head of the Environmental Protection Sub-Department (Department of Agriculture and Environment) Vo Thanh said that previously, the tasks of granting, changing, adjusting, re-granting, and revoking environmental licenses were decentralized to the district level and the Department of Agriculture and Environment. Now that the district level is no longer available, this task is decentralized and authorized to the People's Committees of wards and communes.

However, the Department of Agriculture and Environment also advised the City People's Committee to authorize the Department to handle environmental records for large-scale, complex investment projects and facilities. For smaller-scale projects and facilities that are suitable for the capacity of the People's Committees of wards and communes, the City People's Committee will advise the City People's Committee to decentralize and authorize the locality.

After the merger, with the distance from the city to many localities from 100 - 200km, the authorization of the City People's Committee to wards and communes to handle environmental records for investment projects and facilities will create many conveniences for businesses, production, business and service establishments.

The Department of Agriculture and Environment has sent a document requesting the People's Committees of wards and communes to register their needs for training and coaching for cadres (leaders) and civil servants in charge of environmental work in the coming time, in order to effectively carry out the tasks of decentralization, delegation of authority, and settlement of related administrative procedures.

In addition, the department also established a group to discuss and provide professional guidance on the social network Zalo to quickly grasp problems and difficulties and support timely resolution of records, procedures as well as environmental management work in localities.
