Removing land acquisition bottlenecks for key projects.

Despite having many key projects underway, land clearance in Nghi Son town is facing numerous difficulties and obstacles. The Nghi Son Town Party Committee and People's Committee are making efforts to mobilize the entire political system in the campaign and propaganda work; at the same time, focusing on conducting land inventory, land acquisition, compensation, support, and resettlement to quickly create clean land for projects to be implemented smoothly.

Removing land acquisition bottlenecks for key projects. The road, part of the Integrated Development Project for Dynamic Urban Areas - Tinh Gia Urban Sub-project, has not yet been connected due to ongoing land clearance issues.

The Dong Vang Industrial Park project covers an area of ​​491.9 hectares, located in the communes of Tan Truong, Tung Lam, and Phu Lam in Nghi Son town. With a total investment of 2,400 billion VND, this project is expected to be a comprehensive and exemplary development, meeting the needs for large-scale factory construction and serving as an "anchor" for the development of Industrial Park No. 15 in the Nghi Son Economic Zone. However, the project is facing the risk of delays due to numerous difficulties.

According to the Nghi Son Town People's Committee, the total area requiring land clearance for this project amounts to 467.39 hectares, affecting 413 households and 12 organizations. However, currently, 199.47 hectares remain unhanded over. One of the significant difficulties is the issue of allocating resettlement land for the wastewater treatment plant. Twelve households in the wastewater treatment plant area are eligible for resettlement land allocation, with seven registered in the Truc Lam resettlement area and five in the Hai Binh resettlement area. However, the Nghi Son Town People's Committee lacks the necessary grounds to issue decisions on land allocation and land use fee collection.

In addition, there are difficulties in resolving overlapping land issues with land leased from the Nghi Son Town Protective Forest Management Board. Accordingly, 59.45 hectares have been subject to land reclamation decisions, mostly without compensation for the land itself, only compensation for crops; however, the households do not agree with the reclamation decisions.

Also related to the Dong Vang Industrial Park Project, its implementation will require the resettlement of 238 households currently residing in Tung Lam and Phu Lam communes. The project to invest in and construct resettlement areas in Tung Lam and Phu Lam communes is currently underway. However, the implementation of these two projects continues to face difficulties due to obstacles in land clearance for 10.26 hectares of land belonging to organizations and individuals.

According to the Land Clearance and Resettlement Support Board of Nghi Son town, to date, notices of land acquisition have been issued for these two resettlement areas, land inventory has been completed, land origin has been verified, and specific land prices have been determined, but there is no basis for compensation yet. The reason is that from August 1st, the Land Law No. 31/2024/QH15 and Government Decree 88/2024/ND-CP regulating compensation, support, and resettlement when the State acquires land came into effect; accordingly, Decision No. 16/2023/QD-UBND dated April 20, 2024, of the People's Committee of Thanh Hoa province regulating compensation, support, and resettlement when the State acquires land in Thanh Hoa province has expired. To date, the Provincial People's Committee has not issued regulations on compensation, support, and resettlement when the State reclaims land to replace Decision 16/2023/QD-UBND dated April 20, 2024. Therefore, the Nghi Son Town People's Committee has no basis to issue a decision approving the compensation plan for the remaining areas of the project.

Another project that Nghi Son town is focusing its efforts on for land clearance is the Integrated Urban Development Project - Tinh Gia Urban Sub-project. This project uses World Bank loan funds, and the financing agreement will close on June 30, 2025. However, the project still faces obstacles in land clearance implementation for many items such as: the construction of the resettlement area in Xuan Lam ward, the renovation of Cau Trang canal (Hai Hoa ward), Than canal, Binh Minh road, and the road from National Highway 1A to Ninh Hai beach.

According to the Land Clearance and Resettlement Support Board of Nghi Son town, the unit is currently focusing on resolving all outstanding issues to hand over the Coal Canal section before September 30th; at the same time, accelerating the progress of allocating resettlement land to the remaining households that have not yet been approved for resettlement, completing the handover in October 2024 to generate revenue to support compensation and land clearance for the remaining sections.

According to Plan No. 06/KH-UBND dated January 5, 2024, of the Provincial People's Committee, Nghi Son town was assigned to clear land for 59 projects, with a total area of ​​nearly 386.7 hectares. Of these, 42 are public investment projects and 17 are projects invested by businesses. As of the end of August 2024, the land clearance rate for direct investment projects had reached 85.8%; however, land clearance for public investment projects had only reached 36.8%.

Currently, the Standing Committee of the Nghi Son Town Party Committee is focusing on directing and assigning responsibility to the heads of Party committees, government agencies, and heads of units, departments, and teams in land clearance work to continue disseminating information to gain public consensus on land clearance. The Town People's Committee has also requested the People's Committees of communes and wards with projects to focus on resolving disputes and petitions from the people regarding land and assets attached to the land; carrying out the task of examining the origin, time, and process of land use, determining eligible subjects for resettlement, and eligibility for support policies in accordance with the law, ensuring compliance with deadlines as required.

To create a legal framework for fundamentally resolving land clearance issues in the coming period, the town is requesting the Provincial People's Committee to promptly issue decisions amending Decision No. 16/2023/QD-UBND dated April 20, 2023, regulating compensation, support, and resettlement when the State recovers land in Thanh Hoa province. This will provide the Nghi Son Town People's Committee with a basis to approve compensation plans and prepare the land for projects to continue implementation according to schedule.
