The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2020/ND-CP dated August 1, 2020 of the Government. Accordingly, the subjects of application are teachers who are teaching and educating in public educational institutions.
Clause 2, Article 3 of this Decree stipulates that the period of time not counted for seniority allowance for teachers includes sick leave and maternity leave exceeding the time limit prescribed by the law on social insurance.
According to your letter, you were recruited as a civil servant at a public school on September 1, 2019, but participated in compulsory insurance from July 1, 2018.
Therefore, from the date of participating in teaching and education with compulsory social insurance payment until 5 years (60 months), excluding probationary period, you are eligible for seniority allowance equal to 5% of current salary plus leadership position allowance and seniority allowance exceeding the framework (if any).
From the sixth year onwards, each year (full 12 months) is calculated with an additional 1%. Seniority allowance is calculated and paid with the monthly salary and is used to calculate social insurance, health insurance, and unemployment insurance contributions and benefits.
How to calculate monthly seniority allowance:
Seniority allowance level = Salary coefficient according to the civil servant's professional title plus current leadership position allowance coefficient, seniority allowance exceeding the framework (if any) x Basic salary level prescribed by the Government from time to time x Level (%) of seniority allowance enjoyed
