Recovered more than 1,200 billion VND from economic and corruption cases in the first 9 months of the year

In the first 9 months of this year, courts sentenced 490 defendants involved in economic and corruption cases, recovering more than 1,200 billion VND.

The above figures were mentioned by Chief Justice of the Supreme People's Court Nguyen Hoa Binh in his report on the implementation of the National Assembly's resolution on thematic supervision and questioning in the court sector, which took place on the morning of November 6.

Chief Justice Nguyen Hoa Binh said that from July 1, 2019 to June 30, 2023, the courts accepted 126 cases with 375 defendants; resolved and tried 114 cases with 348 defendants for crimes of violating regulations on land use, compensation, support, and resettlement when the State reclaims land (reaching a rate of 90.5% in terms of the number of cases and 92.8% in terms of the number of defendants, exceeding 2.5% of the target set by the National Assembly ).

"100% of cases related to urban planning, management and land use were brought to trial within the time limit prescribed by law. The quality of settlement and trial was guaranteed. To date, no cases of wrongful convictions or signs of criminals being let off the hook have been discovered," the Chief Justice of the Supreme People's Court informed.

In addition, Mr. Binh said, the Supreme People's Court has focused on applying measures to recover State assets that have been appropriated or damaged.

In the first 9 months of 2023 alone, the courts have ordered the recovery of money and assets in 147 cases, with a total of 490 defendants in economic and corruption cases with money and assets worth more than VND 1,200 billion. Currently, 396 defendants in 109 cases have remedied the consequences, returning the misappropriated assets worth more than VND 408 billion.

Emphasizing the active organization of online trials, Chief Justice Nguyen Hoa Binh said that as of June 30, 682 courts had organized online trials with 8,381 cases. Through online trials, an estimated total cost of VND45 billion was also saved.

However, he also said that the rate of judgments and decisions on administrative cases that were annulled or amended due to subjective reasons of the court did not meet the target set by the National Assembly, the number of staff did not meet the requirements of the tasks, facilities, equipment, and working conditions of some units. Meanwhile, some court officials did not strictly comply with public service discipline, leading to disciplinary action...

Reporting on the review of trial work, Secretary General of the National Assembly Bui Van Cuong acknowledged the results in the court sector, such as the quality of the work of resolving and adjudicating all types of cases being focused on. The resolution of petitions for review and retrial has changed, with progress and resolution quality being improved.

However, the rate of judgments and decisions on administrative cases that were annulled or amended due to subjective reasons of the court has not met the target assigned by the National Assembly.

Presenting a report to the National Assembly, Chief Justice of the Supreme People's Procuracy Le Minh Tri reviewed some of the results of the past period. The rate of people arrested, detained and then transferred for criminal prosecution reached 99%; the number of cases prosecuted by the Procuracy on time reached 100% and the number of defendants prosecuted by the Procuracy with the correct charges reached 99.99%.

The Procuracy also promptly detected violations of the law and issued many recommendations requiring the correction of violations and crime prevention, with an acceptance rate of 98.6%; the rate of appeals, final appeals, and retrials of criminal cases accepted by the Trial Council exceeded the requirements in Resolution No. 96 of the National Assembly.

The Director said that the agency has done a good job in fighting wrongful convictions and missing criminals; focused on strengthening the responsibility of the prosecution in investigation activities, striving to prevent cases of suspension of defendants due to non-compliance, and the court declaring the defendant not guilty.
