According to Musician Dinh Trung Can, the above copyright fees are collected from many fields such as: Live performances and concerts; websites, music applications; ringback tones, phone ringtones; CD and DVD duplication; duplication in movies, TV shows, in advertisements; demo and online duplication; copyright from radio and television programs; restaurants, cafes, karaoke, pubs, tea rooms, licensing in provinces, royalties from international CMOs... In which, the highest amount of music copyright fees are from websites and music applications, reaching over 260 billion (accounting for 76%). The remaining revenue from live performances and concerts accounts for 4%, background music 5%, online duplication 4%, international CMOs 4%, radio and television broadcasting 3%, other fields 4%...
Musician Dinh Trung Can shared that in 2023, the Vietnam Center for Music Copyright Protection has made 4 distribution periods, paying nearly 306 billion VND to copyright owners, an increase of 90% compared to 2022. It is expected that before the Lunar New Year 2024, the Center will pay the copyright amount for the fourth quarter of 2023 to the owner members.
In addition to music copyright collection and payment activities, in 2023, the Vietnam Center for Music Copyright Protection supported, provided legal advice, and resolved complaints of member authors to protect their legitimate rights and interests according to regulations; strengthened the review and handling of copyright violations, and protected the legitimate rights and interests of member authors, especially in the performance and online fields. The Center supported the care and development of members, resolved complaints, provided legal advice to member authors, organized mediation when there were disputes and recommendations; and consolidated the legal basis to best manage, exploit, and protect the legitimate rights and interests of member authors. To date, the Legal Department of the two regions has handled 34 lawsuits on copyright infringement, intellectual property disputes, and contract disputes; 20 out of 40 cases have been resolved, and we are continuing to speed up the warning of violations and file lawsuits for the next violations.
The Center has promoted foreign affairs, focusing on expanding cooperation strategies with organizations around the world , sending staff to attend training courses organized by CISAC to improve the quality of human resources; organizing international seminars on music copyright with the support of CISAC, Meta Company (Facebook) and partners, member authors... Currently, the Center has signed authorization agreements with 86 collective rights management organizations with a scope of regulation in 154 countries and territories around the world.
Musician Dinh Trung Can said that the Vietnam Center for Music Copyright Protection often faces difficulties because many performance organizers still delay paying royalties, abuse the agreement mechanism to intentionally obscure the author's "exclusive" rights as prescribed by law, as well as avoid the obligations of the user, causing difficulties and costs in processing, time, and human resources for the Center. Some units prolong the agreement, but when requested, they pay before the performance. Some units are not willing to pay royalties, and the legal department is currently preparing a lawsuit.
“In the coming time, we will make recommendations to state management agencies about some shortcomings related to the field of music copyright, aiming to both ensure businesses operate and organize performances, and ensure the enforcement of intellectual property laws for collective rights protection organizations such as the Vietnam Center for Music Copyright Protection,” said musician Dinh Trung Can.
