Salary and salary-related regimes of civil servants are stipulated in Article 12 of Law on Civil Servants No. 58/2010/QH12 of 2010.
Officials are entitled to overtime pay, night shift pay, business trip allowances and other benefits according to the provisions of law and regulations of public service units; are entitled to bonuses and salary increases according to the provisions of law and regulations of public service units.
Therefore, the Tet bonus for civil servants will be in accordance with the provisions of law and the regulations of the public service unit. In particular, currently, as with civil servants, there are still no detailed regulations on the issue of Tet bonuses for civil servants.
According to the provisions of Labor Code No. 45/2019/QH14, Tet bonuses as well as other types of bonuses are not considered mandatory obligations of employers.
Article 103 of this Code only stipulates that bonus is an amount of money that the employer rewards the employee based on the annual production and business results and the employee's level of work completion.
Therefore, according to the above regulations, the Tet bonus for civil servants and public employees will be decided by State agencies and public service units based on the assessment of the capacity and work efficiency of each subject. At that time, the specific Tet bonus level will also be decided by these units and agencies.
In addition, from July 1, 2024, a comprehensive salary reform will be implemented for officials, civil servants, public employees and workers in state agencies and public service units.
At that time, the income structure of cadres, civil servants and public employees will be supplemented with a bonus of 10% of the total salary fund of this group. And possibly, this bonus will include the Tet bonus.
