Continue to apply special mechanisms and policies to build nuclear power projects.

Special mechanisms and policies for investment and construction of nuclear power projects and research nuclear reactor projects issued before the effective date of the Law on Atomic Energy (amended) shall continue to be implemented until there is a document abolishing or replacing them with other legal documents.

On the morning of June 27, at the 9th Session, with 441/442 delegates present voting in favor, the 15th National Assembly passed the Law on Atomic Energy (amended).

Regarding state management in the field of atomic energy, because radiation safety, nuclear safety and nuclear security are particularly important issues, the Law stipulates the national nuclear and radiation safety agency, ensuring compliance with the requirements of the International Atomic Energy Agency (IAEA), international treaties to which Vietnam is a member, international practices and the context of Vietnam.

Accordingly, the national radiation and nuclear safety agency is a specialized agency that assists the central agency to act as a focal point for implementing state management in the field of atomic energy, managing and implementing state management tasks on radiation safety, nuclear safety and nuclear security, nuclear inspection and other functions and tasks as prescribed in this Law and other relevant legal provisions.

The Government shall detail the national nuclear and radiation safety agency to ensure the principle of separation between the state management function of radiation safety, nuclear safety and nuclear security and the development and application of atomic energy.

Regarding radiation safety, nuclear safety and nuclear security, the Law devotes a separate chapter to regulate radiation safety, radiation protection, nuclear safety and nuclear security, including regulations on locations for storing, processing and burying radioactive waste, spent radioactive sources and spent nuclear fuel determined in national environmental protection planning, regional planning, provincial planning, development planning, atomic energy application and other relevant planning.

Regarding nuclear power plants, the Law stipulates safety supervision and security assurance throughout the life cycle of nuclear power plants, ensuring consistency of the legal system, in accordance with international practices and IAEA guidelines.

The new law also provides transitional provisions on special mechanisms and policies for investment and construction of nuclear power projects and research nuclear reactor projects issued before the effective date of this law.

These mechanisms and policies shall continue to be implemented until they are abolished or replaced by other legal documents or abolished in writing by competent agencies or individuals.

In addition, nuclear power projects that have been decided on investment policies before the effective date of this Law shall be implemented according to the National Power Development Plan in cases where other plans at the same level, regional plans, provincial plans or plans of a technical or specialized nature have not been updated, adjusted or supplemented.

The Law on Atomic Energy (amended) takes effect from January 1, 2026.
