Classification criteria, conditions for establishment, merger, consolidation, and dissolution of public service units in the planning, investment, and statistics sectors and fields.

(MPI) - On June 24, 2024, the Minister of Planning and Investment issued Circular No. 11/2024/TT-BKHĐT stipulating classification criteria, conditions for establishment, merger, consolidation, and dissolution of public service units in the planning, investment, and statistics sectors and fields.

This Circular does not apply to: Public service units under or directly under the Ministry of Public Security and the Ministry of National Defense; Public service units under the management of special administrative-economic unit authorities; Public service units abroad; Public service units under or directly under the Ministry of Planning and Investment with fields of operation in press, publishing, information and communication, science and technology, economics, higher education, vocational education and fields of operation under the state management functions of other ministries and branches.

Criteria for classifying public service units according to functions and tasks

Public service units perform the function of research to serve the development of legal documents, perfecting institutions, planning, plans, strategies, regimes, policies, standards, regulations, economic -technical norms in the planning, investment and statistics sector and fields; Public service units perform the task of building, managing, operating, exploiting, and developing information systems to serve state management in the planning, investment and statistics sector and fields; Public service units perform the function of supporting, serving inspection, examination, and supervision of the quality of specialized services in the planning, investment and statistics sector and fields; Public service units perform other functions and tasks to serve state management in the planning, investment and statistics sector and fields.

Public service units provide public service services in the planning, investment and statistics sectors and fields according to the list approved by competent authorities.

A public service unit that both serves state management and provides public service in the planning, investment and statistics sector is a public service unit that performs one or more functions and tasks specified in Clause 1 and one or more functions and tasks specified above. The determination of the type of public service unit specified is decided by the competent authority.

Criteria for classifying public service units according to the level of financial autonomy

Public service units self-insure regular and investment expenses; Public service units self-insure regular expenses; Public service units self-insure a part of regular expenses including Public service units self-insure from 70% to less than 100% of regular expenses; Public service units self-insure from 30% to less than 70% of regular expenses; Public service units self-insure from 10% to less than 30% of regular expenses.

Public service units have their regular expenditures guaranteed by the State Budget. The determination of the level of financial autonomy of public service units is implemented according to the Government's regulations on the financial autonomy mechanism of public service units.

Conditions for establishing public service units

The establishment of public service units in the planning, investment and statistics sector and field must satisfy the conditions prescribed in Points a, c, d, and dd, Clause 1, Article 5 of Decree No. 120/2020/ND-CP dated October 7, 2020 of the Government regulating the establishment, reorganization and dissolution of public service units.

In addition to the general conditions prescribed, the establishment of public service units in the planning, investment and statistics sectors and fields must also satisfy other conditions as prescribed by relevant laws.

Conditions for merging and consolidating public service units

The merger or consolidation of public service units in the planning, investment and statistics sector and field shall be carried out when meeting the conditions specified in Points a, b, c, Clause 2, Article 5 of Decree No. 120/2020/ND-CP.

Public service units established after merger or consolidation must satisfy all the establishment conditions prescribed in Article 5 of this Circular and relevant legal provisions.

Conditions for dissolution of public service units

The dissolution of a public service unit in the planning, investment and statistics sector or field is carried out when one of the conditions specified in Points a, b, c, d, Clause 3, Article 5 of Decree No. 120/2020/ND-CP is met.

A public service unit shall only be dissolved after fulfilling its obligations regarding finance, assets, land, loans, debts, and other obligations as prescribed by law and having been confirmed in writing by a competent authority or organization.

This Circular takes effect from August 10, 2024./.
