Proposal for 9 groups of transactions that must be notarized

The Ministry of Justice is seeking comments on a draft law amending and supplementing a number of articles of the Law on Notarization. Notably, the draft law supplements and expands the number of transactions that must be notarized and notarized transactions upon request.

Transactions that must be notarized under the bill include:

1. Contracts for transfer, donation, mortgage, capital contribution using land use rights, land use rights and assets attached to land, except for contracts for lease, sublease of land use rights, land use rights and assets attached to land, contracts for conversion of agricultural land use rights; contracts for transfer, capital contribution using land use rights, land use rights and assets attached to land, assets attached to land in which one party or parties participating in the transaction is a real estate business organization.

2. Agreement document of members sharing land use rights agreeing to transfer land use rights to the enterprise.

3. Contracts for sale, hire-purchase, donation, exchange, capital contribution, mortgage of housing, except for cases where organizations donate houses of gratitude, charity houses, and great solidarity houses; sale, hire-purchase of public property houses; sale, hire-purchase of houses where one party is an organization, including: social housing, housing for the people's armed forces, housing for resettlement; capital contribution in housing where one party is an organization; renting, borrowing, staying at, or authorizing housing management.

4. Documents on donation of real estate, except for cases registered under the provisions of law; contracts on transfer of real estate business; contracts on sale and purchase, hire-purchase of houses, construction works, construction floor area in construction works in which the parties involved in the transaction are individuals.

5. Documents on inheritance of land use rights, land use rights and assets attached to land; documents of approval of land users for construction works; documents on inheritance of houses.

6. Document of guardian selection.

7. Will of a physically handicapped person or an illiterate person.

8. Written agreement establishing the property regime of spouses before marriage; written document amending and supplementing the content of the agreement on the property regime of spouses.

9. Authorization document to resolve the enforcement of judgments related to assets when the judgment debtor leaves the country.

According to the meeting agenda, this morning (November 26), the National Assembly will vote to pass a number of important laws. Specifically, voting to pass the Extradition Law; the Law on Transfer of Persons Serving Prison Sentences; the Law on Mutual Legal Assistance in Civil Matters; and the Law on Mutual Legal Assistance in Criminal Matters.

Afterwards, the National Assembly discussed in the hall the draft Law on National Reserves (amended).

In the afternoon, the National Assembly will discuss the draft Law amending and supplementing a number of articles of the Law on International Treaties. The draft Resolution of the National Assembly on a number of specific mechanisms and policies to improve the effectiveness of international integration.

The People's Committee of Ca Mau province has just registered with the Ministry of Construction to start construction of two projects on December 19 to celebrate the 14th Party Congress.

The first project is the outer ring road project of Bac Lieu city (phase 1) passing through Bac Lieu ward, with a total length of more than 9.5km, starting at Nguyen Van Cu street and ending at Cao Van Lau street. The project has a total investment of 1,440 billion VND.

The second project is the inner ring road project of Bac Lieu city (phase 1) in Vinh Trach ward, with a total length of 1.7km, the starting point intersects with the outer ring road of Bac Lieu city mentioned above, the end point connects to Ham Nghi street (residential area of Vinh Trach ward). The project has a total investment capital of more than 294 billion VND.

The above two projects are invested by the Bac Lieu Traffic Construction Investment Project Management Board, using central and local budget funds.
