Ho Chi Minh City issues regulations on procedures for short-term land lease

The Ho Chi Minh City People's Committee has just issued Decision 71/2025/QD-UBND regulating the procedures for short-term leasing of land funds and assets attached to land managed by the Ho Chi Minh City Land Fund Development Center. The Decision takes effect from June 5, 2025.

According to regulations, land funds that have been planned for auction, land funds expected to pay for BT contracts or created after compensation and site clearance are allowed to be leased short-term with a term of no more than 12 months. If after this term the auction has not been organized, the land has not been allocated or the BT contract has not been signed, it can be extended for a maximum of 12 months at a time, the total lease and extension period cannot exceed 60 months.

For land funds that have not yet been allocated and are not included in the annual auction plan, the lease term is stipulated from 12 to 60 months. In case of land lease with a term not exceeding 60 months/time, the Ho Chi Minh City Land Fund Development Center will liquidate the contract and organize a public announcement to re-select organizations and individuals to lease short-term land after the contract expires.

In case of land lease with remaining terms, Ho Chi Minh City Land Fund Development Center shall consider extending the next lease term with a term ensuring that the total land lease term and extension do not exceed 60 months.

Regarding the short-term land rental price, it is determined according to the formula: Starting price for short-term land rental/ m2 /month = Land price to calculate short-term land rental multiplied (x) Percentage (%) to calculate land rental price divided (÷) 12.

In which, the land price for calculating short-term land rental is the price in the Land Price List (calculated in units of 1,000 VND/ m2 ). The percentage (%) for calculating the land rental price is from 0.25 to 3% (the rate is based on the area and location issued by the People's Committee of Ho Chi Minh City in Decision 09/2025 dated January 20, 2025.
