Strictly handle acts of abusing inspection and examination

On the morning of May 15, the National Assembly listened to Minister of Finance Nguyen Van Thang, authorized by the Prime Minister, present the draft Resolution of the National Assembly on mechanisms and policies for private economic development.

Accordingly, the draft resolution stipulates that inspection and examination of each enterprise, business household, and individual business must not be carried out more than once a year, except in cases where there are clear signs of violations.

Notably, inspection and examination plans and conclusions must be made public in accordance with the law. Strictly handle acts of abusing inspection and examination to harass and cause difficulties for businesses, households and individuals.

Prioritize remote inspection and testing based on electronic data, reduce direct inspection and testing.

In the report, according to Minister Nguyen Van Thang, for violations and cases related to civil and economic matters, priority will be given to applying civil, economic and administrative measures first; enterprises, business households and business individuals will be proactive in remedying violations and damages.

In cases where the practical application of the law may lead to criminal proceedings or no criminal proceedings, criminal proceedings shall not be applied.

Even for violations that are subject to criminal prosecution, priority should be given to proactive, timely and comprehensive measures to remedy economic consequences. This is also an important basis for the prosecution agency to consider when deciding to initiate, investigate, prosecute, try and take further measures.

Legal provisions may not be applied retroactively to disadvantage businesses, business households, or business individuals.

For cases where information, documents and evidence are not clear enough to conclude that there is a violation of the law, a conclusion must be reached promptly in accordance with the provisions of procedural law and this conclusion must be publicly announced...

Regarding administrative procedure reform, the provisions in the draft are built on the principle of simplifying administrative procedures, reducing adverse impacts on state management, and creating maximum convenience for production and business activities of people and enterprises.

Expanding private participation in key projects

To achieve the goal of having at least 20 large private enterprises participating in the global value chain by 2030, the draft resolution proposes two groups of policies.

First, ordering, limited bidding, and designated bidding to implement key and important national projects.

Accordingly, the State expands the participation of private enterprises in key and important national projects through direct investment or investment under the public-private partnership method or cooperation models between the State and the private sector in accordance with the provisions of law.

Competent persons and investors shall select the form of ordering, limited bidding, designated bidding or other forms as prescribed by law to implement strategic and key national projects (high-speed railways, urban areas, foundational and spearhead industries, energy infrastructure, digital, green transport, national defense, security, and urgent tasks) to ensure publicity, transparency, quality, and progress.

Second , support the formation and development of medium and large enterprises and private economic groups of regional and global stature.

The State allocates budget for two programs to support medium and large enterprises and private economic groups according to two programs: One is to develop 1,000 typical enterprises in science and technology, innovation, digital transformation, green, high-tech industry; supporting industry; two is to support reaching out to international markets, support in markets, capital, technology, brands, distribution, logistics, insurance, legal advice, dispute resolution and connection with multinational corporations.
