In addition to the public school system that has existed for many years, there are also many private schools and non-public schools that have been newly built in recent times. These two school systems attract a large number of students, not less than public schools.
Are public and private schools the same?
According to Point b, Point c Clause 1 Article 47 of the 2019 Law on Education , a private school is a type of school in which the community at the grassroots level, including organizations and individuals in villages, hamlets, communes, wards, and towns, invests in building facilities and ensuring operating conditions. The type of private school only applies to preschool education facilities.
Meanwhile, private schools are invested by domestic or foreign investors and have guaranteed operating conditions.

A non-profit private school is a school in which the investor commits and fulfills the commitment to operate non-profitably, as stated in the decision to establish or the decision to convert the school type; operates non-profitably, does not withdraw capital, and does not receive profits; the annual accumulated profits are jointly owned and not divided to continue investing in school development.
Thus, a private school is a school in which the community at the grassroots level, including organizations and individuals in villages, hamlets, communes, wards, and towns, invests in building facilities and ensures operating conditions. Meanwhile, a private school is invested in by domestic or foreign investors and ensures operating conditions.
Procedures for converting public schools to private schools
Pursuant to Clause 2, Article 47 of the 2019 Law on Education, which stipulates the principles of converting school types in the national education system, the conversion of school types in the national education system is carried out according to the following principles:
- Only change the school type from private school to non-profit private school;
- Implement the provisions of the charter, regulations on organization and operation of the school type at each level of education and training;
- Ensure the rights of teachers, lecturers, educational administrators, workers and learners;
- No loss of land, capital and assets.
Along with that, the procedure for converting a private university into a public university is carried out according to the provisions of Article 10 of Circular 45/2014. Specifically, the Board of Directors of the private school is responsible for submitting 05 sets of documents specified in Article 9 of this Circular to the Ministry of Education and Training .
Within 30 working days from the date of receiving valid documents, the Ministry of Education and Training shall review the conversion project and submit it to the Prime Minister for decision on converting the school type.
After the Prime Minister issues a decision to recognize a private school, the Chairman of the Board of Directors of the private school chairs a meeting of the capital contributors to elect members representing the capital contributors in the Board of Directors of the private school.
At the same time, the Principal of the private school chairs the meeting of permanent lecturers of the private school to elect members representing permanent lecturers in the Board of Directors of the private school. The Party organization and mass organizations of the private school chair the election of members representing the Party organization and mass organizations in the Board of Directors of the private school.
The Chairman of the Board of Directors of a private school shall make a written request to the People's Committee of the province or centrally-run city where the school has its headquarters to send representatives to participate in the Board of Directors of the private school.
Finally, the Chairman of the Board of Directors, the Principal, and the Chief Accountant of the private school hand over the documents to the Chairman of the Board of Directors, the Principal, and the Chief Accountant of the private school.
