At the recent 9th Session, the 15th National Assembly passed the Law on Digital Technology Industry consisting of 6 chapters with 51 articles, including a separate chapter regulating artificial intelligence.
Article 44 of the Law on Digital Technology Industry specifically stipulates identification marks for artificial intelligence systems.
Accordingly, an artificial intelligence system that interacts directly with a human must notify the user that it is interacting with the artificial intelligence system, except in cases where the user is obviously aware that it is interacting with the artificial intelligence system.
Digital technology products in the List of digital technology products created by artificial intelligence must have identification marks for users or machines to recognize.
The Minister of Science and Technology is responsible for promulgating the List of digital technology products created by artificial intelligence; at the same time, organizing the inspection of the implementation of regulations on identification marks for the above-mentioned artificial intelligence systems.
The Law on Digital Technology Industry also stipulates 7 principles for developing, providing, and deploying the use of artificial intelligence, including:
Serving human prosperity and happiness, taking people as the center, improving productivity and work efficiency, promoting intelligence; inclusive, flexible, fair and non-discriminatory approach; respecting ethical and national values; human rights, civil rights, rights and legitimate interests of organizations and individuals;
Ensure transparency, accountability, explainability; ensure that it does not exceed human control;
Ensure network safety and security;
Ensure compliance with legal regulations on data and personal data protection;
Ensure the ability to control algorithms and artificial intelligence models;
Risk control throughout the lifecycle of artificial intelligence systems;
Ensure compliance with laws on consumer protection and other relevant laws.
Ministers and heads of ministerial-level agencies shall, based on practical situations, guide the principles of development, provision, and deployment of artificial intelligence in assigned sectors and fields.
The Law on Digital Technology Industry takes effect from January 1, 2026.
