From August 15, 2024, many new regulations on bank establishment and operation

(PLVN) - The State Bank of Vietnam (SBV) has just issued Decision 1640/QD-NHNN on promulgating newly issued, amended and supplemented administrative procedures (AP) in the field of bank establishment and operation implemented at the One-Stop Department under the management scope of the SBV.

This Decision amends, supplements and replaces the provisions of Circular 32/2024/TT-NHNN dated June 30, 2024, implemented at the One-Stop Department under the management scope of the State Bank.

Accordingly, the newly issued administrative procedure is implemented at the One-Stop Department under the scope and management function of the State Bank of Vietnam, which is the Procedure for approving eligibility to convert the legal form of a foreign subsidiary bank.

The amended and supplemented administrative procedures are within the scope of management functions of the State Bank, implemented at the State Bank, including: Procedures for approving eligibility to establish domestic branches of commercial banks; Procedures for approving eligibility to establish transaction offices of commercial banks; Procedures for approving the establishment of branches, representative offices, and subsidiary banks abroad of commercial banks; Procedures for approving the establishment of representative offices and public service units in the country of commercial banks.

The amended and supplemented administrative procedures are within the scope of management functions of the State Bank, implemented at the State Bank branches in provinces and centrally run cities, including: Procedures for approving changes in branches managing transaction offices of commercial banks; Procedures for voluntarily terminating the operation of domestic branches of commercial banks; Procedures for approving commercial banks to voluntarily terminate the operation of transaction offices.

List of replaced administrative procedures under the management scope of the State Bank, including: Procedures for approving changes in locations of domestic branches and transaction offices within provinces and centrally run cities and Procedures for approving changes in locations of domestic branches and transaction offices between provinces and centrally run cities; The replaced administrative procedure is Procedures for approving changes in locations/confirming changes in addresses (without changing locations) of domestic branches and transaction offices of commercial banks.

This Decision takes effect from August 15, 2024. This Decision amends, supplements and replaces administrative procedures with codes: 2.001399, 2.001392, 1.003334, 2.001380, 1.000194, 1.000206, 1.000394, 1.002167 announced in Decision 177/QD-NHNN dated February 21, 2022.
