Authority to establish planning tasks, planning for preservation, renovation and restoration of relics:
The Decree stipulates that the Chairman of the People's Committee of the province where the relic is located or the Minister, head of the sector, agency, or central organization assigned to directly manage the relic is responsible for organizing the planning task and planning for the preservation, restoration, and rehabilitation of the relic (relic planning).
In case the relic is under the management authority of the provincial People's Committee or the Minister, head of the central sector, agency or organization, and is distributed in two or more provinces, based on the distribution of the relic with important and typical values, the Minister of Culture, Sports and Tourism shall unanimously decide to assign the provincial People's Committee or the Minister, head of the central sector, agency or organization to take the lead and be responsible for establishing the planning task and planning the relic after receiving the proposal of the Chairman of the provincial People's Committee or the Minister, head of the central sector, agency or organization with the relic.
Authority to appraise planning tasks and relic planning:
The Decree stipulates that for world heritage sites and special national relics, the Ministry of Culture, Sports and Tourism shall preside over and coordinate with relevant ministries and branches to appraise and submit to the Prime Minister for approval the task of planning and relic planning at the request of the Chairman of the Provincial People's Committee or the Minister, head of the branch, agency or organization at the central level assigned to directly manage the relic.
For national relic clusters or national relic clusters with provincial-level relics forming a complex distributed in the same geographical area, the Ministry of Culture, Sports and Tourism shall preside over and coordinate with relevant ministries and branches to appraise the planning task and relic planning at the request of the Chairman of the Provincial People's Committee or the Minister, head of the sector, agency or organization at the central level assigned to directly manage the relic.
Authority to approve planning tasks and relic planning:
The Prime Minister approves the task of planning and planning world heritage sites and special national monuments.
The Chairman of the Provincial People's Committee approves the planning tasks and the planning of relics not under the approval authority of the Prime Minister or the Minister, the head of the sector, the agency, or the central organization assigned to directly manage the relic after receiving the appraisal opinion of the Minister of Culture, Sports, and Tourism; agrees on the planning tasks and the planning of relics under the approval authority of the Minister, the head of the sector, the agency, or the central organization assigned to directly manage the relics in the locality.
In case the relic is distributed in two or more provinces according to the above regulations, the Chairman of the Provincial People's Committee or the Minister, head of the sector, agency, or organization at the central level shall preside over the approval of the planning task and the relic planning after receiving the appraisal opinion of the Minister of Culture, Sports, and Tourism and the agreement opinion of the Chairman of the Provincial People's Committee or the Minister, head of the sector, agency, or organization at the central level assigned to directly manage the relic.
Ministers, heads of sectors, agencies and organizations at the central level assigned to directly manage relics shall approve the planning task and plan national relic clusters or national relic clusters with provincial relics forming a complex distributed in the same geographical area after receiving appraisal opinions from the Minister of Culture, Sports and Tourism and agreement opinions from the Chairman of the People's Committee of the province where the relics are located.
Decree regulating the order in relic planning activities:
1- Establish, appraise and approve the task of establishing a relic planning.
2- Establishing and adjusting relic planning.
3- Collect written opinions and organize to receive and explain opinions of state management agencies, of the community at the site of the relic and opinions of relevant organizations and individuals.
4- Appraise and organize the reception and explanation of appraisal opinions; complete, submit for approval, approve the relic planning, and adjust the relic planning.
5- Announce the relic planning, adjust the relic planning and organize the implementation of the approved relic planning and adjustment of the relic planning.
6- Place boundary markers according to the relic planning, adjust the approved relic planning.
Regarding the task of planning relics, the Decree stipulates:
1- The report explaining the task of planning the relic includes the following contents:
a) Basis for establishing planning tasks;
b) Determine the requirements for research and survey of relics; research and evaluate socio-economic and natural environmental factors related to the planning content; preliminarily review the plans that have been and are being implemented related to the area where the relic planning is expected to be established;
c) Determine the characteristics and typical values of the relic; the nature and function of the relic planning area;
d) Scope of planning research, planning scope;
d) Contents and requirements on orientation for preservation, restoration, rehabilitation and promotion of relic values; orientation for organization of architectural space, landscape and construction of new works;
e) Determine the plan to implement the planning;
g) Other required contents as prescribed by law on planning.
2- Digital maps and printed maps:
a) Map of the relic location at a scale of 1:15,000 or a suitable scale;
b) Current land use map, current status map of constructed works at scale 1:500 - 1:2,000 or appropriate scale;
c) Map identifying relic protection areas at scale 1:500 - 1:2,000 or appropriate scale;
d) Map defining the scope of planning research and the appropriate scale of planning;
d) Relevant maps as prescribed by law on planning.
The Decree specifically regulates the planning of relics as follows:
1- The report explaining the planning of the relic includes the following contents:
a) The basis for planning relics includes: relevant contents stated in the approved socio-economic development, national defense and security strategy of the locality with relics; development strategy of sectors and fields in the same development period; planning of previous periods; approved relic planning tasks.
b) Analysis and assessment of the current status of the relic and land belonging to the relic, including: survey and research results on the characteristics and values of the relic; technical status, management, protection and promotion of the value of the relic; analysis and assessment of factors of the natural and social environment affecting the relic; current status of land use and technical infrastructure of the planning area; determination of typical characteristics and values of the relic, and the relationship of the planned relic with other relics in the research area.
c) Viewpoints, long-term goals and short-term goals.
d) Determine the boundaries of the relic protection area, make recommendations on adjusting the expansion or narrowing of the boundaries of the relic protection area; determine the cultural landscape area of the relic, restricted construction areas, new construction areas; propose additional classification of newly discovered works and locations.
d) Orientation for preservation, renovation and restoration of relics: plan for preservation, renovation and restoration of relics of the entire planning area; list of works in need of preservation, renovation and restoration and level of preservation, renovation and restoration for each work; basic principles and solutions for preservation, renovation and restoration of relics.
e) Orientation to promote the value of relics.
g) Orientation of space organization, height, construction density, architectural form, materials of new construction works; orientation of renovation, construction of technical infrastructure in the relic planning area and other related orientations.
h) Forecast environmental impacts and propose environmental protection measures, minimizing negative impacts on the environment within the scope of relic planning.
i) Propose component project groups, investment phases, priority order and investment capital sources for those component projects.
k) Proposing mechanisms, policies and solutions to implement relic planning.
l) Other relevant requirements as prescribed by law on planning.
2- Digital maps and printed maps:
a) Map of the location of the relic and its relationship with other relics in the planning study area at a scale of 1:5,000 - 1:15,000 or an appropriate scale.
b) Current map of land use, architecture, landscape, technical infrastructure and approved regional construction planning map at scale 1:500 -1:2,000 or appropriate scale.
c) Map identifying the protected area and placing boundary markers of the relic; the area requiring clearance of violations of the relic, scale 1:500 - 1:2,000 or appropriate scale.
d) Master plan map; planning plan for preservation, restoration, rehabilitation of relics and promotion of relic values at scale 1:500 - 1:2,000 or appropriate scale.
d) Map of spatial organization orientation, architecture, landscape, construction of new works and technical infrastructure at scale 1:500 - 1:2,000 or appropriate scale.
e) Other necessary relevant maps as prescribed by law on planning.
Decree regulating the order and procedures for appraising planning tasks and relic planning:
For the task of planning and planning world heritage sites, special national sites, national relic clusters or national relic clusters with provincial-level relics forming a complex distributed in the same geographical area:
The provincial People's Committee or the central ministry, branch, agency or organization assigned to directly manage the relic shall submit online, in person or by post a set of documents as prescribed to the Ministry of Culture, Sports and Tourism.
Within 7 working days from the date of receipt of the dossier of planning task, relic planning, the Ministry of Culture, Sports and Tourism shall be responsible for checking the dossier and notifying in writing the provincial People's Committee or the ministry, branch, agency, or organization at the central level assigned to directly manage the relic if the dossier is incomplete or invalid. The notice must clearly state the reasons and request for supplement or correction of the relevant dossier.
Within 15 working days from the date of receipt of the written notice from the Ministry of Culture, Sports and Tourism, the provincial People's Committee or the ministry, branch, agency or organization at the central level assigned to directly manage the relic shall be responsible for supplementing or editing the relevant dossier. After the above deadline, if the dossier has not been received in full and valid form, the Ministry of Culture, Sports and Tourism shall issue a written return of the dossier.
Within 27 working days from the date of receiving valid dossiers, the Minister of Culture, Sports and Tourism shall be responsible for consulting with relevant ministries, branches and scientists and organizing an Appraisal Council in accordance with the provisions of Article 90 of the Decree detailing a number of articles and measures for organizing and guiding the implementation of the Law on Cultural Heritage.
Within 27 working days from the date of receiving the opinion of the Council for Appraisal of the planning task and relic planning, the Ministry of Culture, Sports and Tourism shall issue a document appraising the planning task and relic planning.
Decree regulating the order and procedures for approving planning tasks and relic planning:
For the task of planning and planning relics that are world heritage sites and special national relics, the Ministry of Culture, Sports and Tourism shall submit online, directly or by post a set of documents as prescribed to the Prime Minister for approval of the task of planning and planning relics.
For the task of planning and planning relics as national relic clusters or national relic clusters with provincial relics forming a complex distributed in the same geographical area:
The investor shall prepare a planning task and plan the relic and send online, directly or by post a set of planning task and planning relic documents according to regulations to the provincial People's Committee, ministry, branch, agency, or central organization assigned to directly manage the relic for approval of the planning task and planning relic.
Within 7 working days from the date of receipt of the dossier of planning task, relic planning, the provincial People's Committee, ministry, branch, agency, central organization assigned to directly manage the relic shall be responsible for checking the dossier and notifying the investor in writing if the dossier is incomplete or invalid. The notice must clearly state the reason and request for supplement or correction of the relevant dossier.
Within 15 working days from the date of receipt of written notice from the provincial People's Committee, the ministry, branch, agency or central organization assigned to directly manage the relic, the investor is responsible for supplementing or editing the relevant documents. After the above deadline, if the valid documents have not been received, the provincial People's Committee, the ministry, branch, agency or central organization assigned to directly manage the relic shall return the documents in writing.
Within 27 working days from the date of receiving the appraisal opinion of the Ministry of Culture, Sports and Tourism, the Provincial People's Committee, the Minister, the head of the sector, the central agency or organization assigned to directly manage the relic shall be responsible for approving the planning task and the relic planning.
The Decree clearly states that for the task of planning and planning relics distributed in two or more provinces, the order and procedures for appraisal and approval of the task of planning and planning relics are implemented as prescribed above.
This Decree comes into force from September 1, 2025.
