Trung Hoa Commune handles illegal construction on agricultural land

Implementing Plan No. 93a/KH-UBND, dated March 31, 2017 of the Provincial People's Committee on clearing illegal constructions on agricultural land; violating the protection corridor of traffic works, irrigation works and illegal wharf and sand mining activities (Plan No. 93a), Trung Hoa commune (Yen My) has strengthened measures to detect early and promptly prevent cases of illegal construction violations on agricultural land.

Trung Hoa Commune (Yen My) organizes enforcement of illegal constructions on agricultural land

Around mid-March 2025, the Security and Order Protection Team at Tam Trach village discovered that Mr. Vu Duc The's family was illegally constructing a structure on agricultural land of about 40 square meters in the village's field. Immediately after that, the team took photos of the scene and reported to the Trung Hoa Commune People's Committee to make a record, issue a decision to impose an administrative penalty, and request the homeowner to dismantle the illegal structure.

Mr. Dang Xuan An, Party Cell Secretary, Head of Tam Trach Village, said: To prevent households from competing with other households to build illegal structures on agricultural land, the village has stepped up propaganda work and established monitoring teams. For households that violate the law, village officials will go to the households to explain, propagate, and request households to voluntarily dismantle illegal structures. In case of intentional violations, the village will report to the Commune People's Committee for handling.

Mr. Pham Hong Phuong, Vice Chairman of Trung Hoa Commune People's Committee, said: In the locality, there are many agricultural land areas attached to residential land areas. Taking advantage of that, some households deliberately built works, even houses on agricultural land. In order to seriously and effectively implement Plan No. 93a, the Commune Party Committee issued a specialized resolution to lead the implementation of handling, clearing violations, inspecting, supervising the implementation; strictly handling cases of violating cadres and Party members. The Commune People's Committee established a Steering Committee to regularly propagate, inspect, review, and classify each specific violation case to have handling measures. Along with that, the Vietnam Fatherland Front Committee of the commune and mass organizations coordinated to meet, dialogue, propagate, and mobilize households to voluntarily dismantle illegal constructions. For households that deliberately violate and build illegal constructions, the Commune People's Committee completed the dossier, developed a plan to organize enforcement. For constructions that violate the authority of the commune, the Commune People's Committee shall make a record, report to the district's professional department for guidance, support and organize enforcement and clearance of violations in accordance with regulations.

From 2023 to present, Trung Hoa commune has promptly prevented 10 cases and organized enforcement of 1 case of illegal construction on agricultural land. Particularly from the beginning of 2025 to present, the commune has discovered 5 cases of construction on agricultural land. Of which, 4 cases were promptly prevented, 1 case was Mr. Dong Huy Bao's family in Cau Thon village who did not comply with the commitment, continued to illegally construct about 75 m2 of agricultural land ^. The commune is taking steps according to its authority to organize enforcement.

Mr. Duong Van Thanh in Tam Trach village shared: The commune's detection and strict handling of intentional violations creates fairness, contributes to good implementation of land management and use, and avoids wasting people's assets.

If people arbitrarily change the land use purpose and then illegally build structures on agricultural land, it will affect land management and local planning if not thoroughly handled. Therefore, along with early detection and thorough handling of newly arising cases, Trung Hoa commune needs to continue to promote propaganda work, raise awareness among cadres, party members and people about the management and use of agricultural land.
