Deputy Prime Minister Tran Hong Ha has just signed Decision No. 258/QD-TTg dated February 10, 2025 on the investment policy for the project to invest in construction and business of infrastructure of Dong Phuc Industrial Park, Bac Giang Province (Project).
The decision clearly states that the investor of the Project is Dong Phuc Industrial Park Infrastructure Development Joint Stock Company.
The project area is 354.63 hectares. The investment capital of the project is about 3,731.713 billion VND, of which the investor's capital contribution is about 559.757 billion VND. The project's operating period is 50 years from the date of the decision on land allocation, land lease, and land use purpose change.
The project is implemented in Dong Phuc and Tu Mai communes, Yen Dung district, Bac Giang province.
The People's Committee of Bac Giang province directed the Management Board of Industrial Parks of Bac Giang province to specify the project implementation progress in the Investment Registration Certificate, but not exceeding 48 months from the date of decision on land allocation, land lease, and change of land use purpose.
According to the Decision, the Ministry of Planning and Investment is responsible for the assigned contents of project investment policy appraisal and state management of industrial parks in accordance with the provisions of the law on investment and relevant laws.
Relevant ministries and branches are responsible for the content of project investment policy appraisal within their functions and tasks according to the provisions of the law on investment and relevant laws.
The Ministry of Natural Resources and Environment is responsible for appraising the environmental impact assessment report of the project in accordance with the provisions of environmental law, in which attention is paid to the discharge of waste from Dong Phuc Industrial Park and the environmental protection work of the investor during the implementation of the project, ensuring compliance with water resources planning and not affecting the water source of Cau River.
Ensure there are no disputes or complaints regarding the right to use the project site.
The People's Committee of Bac Giang province shall organize the development and implementation of plans for land recovery, compensation, support, resettlement, conversion of land use purposes, and land lease to implement the project in accordance with documents approved by competent authorities on the scale, location, and progress of project implementation; ensure that there are no disputes or complaints regarding the right to use the project site; supplement the lost area of land for rice cultivation or increase the efficiency of rice land use according to the provisions of Point b, Clause 4, Article 182 of the Land Law.
In case there are public assets in the project implementation area, it is recommended to comply with the provisions of the law on land and the law on management and use of public assets, ensuring no loss of state assets. The allocation and lease of land for small, narrow plots of land managed by the State (if any) must ensure that they meet the criteria prescribed in Article 47 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law.
The People's Committee of Bac Giang province shall implement solutions to promote investment attraction in industrial park projects in the area; strengthen the monitoring, inspection, supervision and evaluation of investment according to the provisions of law; review cases of projects that do not fulfill their commitments and progress, resolutely handle the suspension or partial suspension of project activities according to the provisions of Point d, Clause 2, Article 47 of the Investment Law; terminate or partially terminate project activities according to the provisions of Point a, Point d, Clause 2, Article 48 of the Investment Law and take full responsibility if infrastructure projects are slow to implement or slow to put land into use according to the provisions of the law on investment and the law on land; Ensure the quality of technical infrastructure of the industrial park is synchronous and modern according to the approved industrial park construction zoning plan, create an industrial land fund to attract investment in Bac Giang province, avoid land waste, complicated complaints and lawsuits from slow-progressing projects; for the establishment of new industrial parks from the time Law No. 57/2024/QH15 takes effect, it is necessary to consider on the basis of an overall assessment of the demand, ability to attract investment and the existing industrial land fund in Bac Giang province and strictly comply with the provisions of the law on industrial parks, economic zones and related laws.
Attracting investment projects into industrial parks in line with development orientation
The Management Board of Industrial Parks of Bac Giang province and relevant agencies monitor and supervise the project implementation process, ensuring compliance with the requirements for protecting and promoting the value of cultural heritage and the conditions prescribed by the law on cultural heritage; inspect and supervise the environmental protection work of the Project, ensuring that the use of water and discharge of wastewater into water sources of the Project are in compliance with the provisions of the law on environmental protection and the law on water resources.
Organize the preparation and approval of the general planning project for the construction of Dong Phuc industrial - urban - service park and related subdivision planning according to the provisions of the law on construction, ensuring synchronous connection of technical infrastructure and social infrastructure between subdivisions; guide, inspect and supervise investors in implementing the subdivision planning for the construction of Dong Phuc industrial park approved by competent authorities, completing construction procedures according to the provisions of the law on construction; ensure the location and area scale of the project are consistent with the project investment policy approved by competent authorities.
Check and determine whether the investor meets the conditions for the State to lease land and allow the change of land use purpose at the time of land lease and permission to change land use purpose; closely monitor the progress of project implementation, the use of equity capital as committed to implement the project, and the satisfaction of all conditions for organizations when doing real estate business.
Use equity capital to implement the project as committed
Dong Phuc Industrial Park Infrastructure Development Joint Stock Company is responsible before the law for the legality, accuracy and honesty of the contents of the project dossier and documents sent to competent state agencies; complies with the provisions of law in implementing the project according to this Decision; invests in the construction of the infrastructure system according to the construction planning of Dong Phuc Industrial Park approved by competent authorities; bears all risks and costs and takes full responsibility according to the provisions of Article 47 and Article 48 of the Investment Law in case of violating the provisions of the law on investment and other provisions of the law on land.
Use equity capital to implement the project in accordance with the commitment; comply with the provisions of the law on investment, the law on land, the law on real estate business and other relevant provisions of law; fully meet the conditions for organizations when doing real estate business as prescribed.
