Reviewing the scientific and rigorous nature of the draft Law on Teachers

On the afternoon of September 24, at the workshop to provide comments on the draft Law on Teachers organized by the Ho Chi Minh City National Assembly Delegation, many opinions said that it is necessary to consider the scientific and strict nature of the draft Law on Teachers to ensure effectiveness when implemented in practice.

According to Deputy Head of the Ho Chi Minh City National Assembly Delegation Ha Phuoc Thang, the draft Law on Teachers, after many comments and amendments, now has 9 chapters and 71 articles. The draft Law on Teachers will be discussed by the National Assembly at the 8th session. In order to complete the draft law, localities will continue to collect opinions from organizations and individuals in society.

At the meeting, Mr. Tran Anh Tuan, Vice President of the Ho Chi Minh City VocationalEducation Association, said that currently the quality of teaching among educational institutions is uneven, and the work pressure on teachers is still great.

“Teachers are the ones who directly use educational policies and programs, participating in the construction and development of educational programs through professional activities. Therefore, the Law on Teachers must demonstrate the important role of teachers in ensuring the quality of education as well as the position of this group in society to be honored and have their rights met,” said the Vice President of the Ho Chi Minh City Vocational Education Association.

Accordingly, policies related to education cannot be developed in isolation but must be consistent, closely linked between levels and grades, and committed to be implemented synchronously in society. In particular, the role and responsibility of state management agencies need to be more clearly mentioned to protect the honor, dignity, and life of teachers, avoiding generalizations, not specifying specific responsibilities, and establishing a monitoring mechanism for the implementation of the Law on Teachers.

From another perspective, Ms. Nguyen Thi Bich Thuy, Vice President of the Ho Chi Minh City Association of Former Teachers, informed that currently most countries in the world do not have separate laws on teachers but are regulated in the education law and related specialized laws.

Therefore, it is necessary to clearly explain the scientific nature, legality and practical needs of promulgating the Law on Teachers, ensuring consistency and no overlap between the draft Law on Teachers and current laws, including the Law on Education, Law on Higher Education, Law on Civil Servants, Labor Code, and Law on Vocational Education.

Ms. Nguyen Thi Bich Thuy expressed her opinion at the workshop.

“The law should provide regulations allowing the education sector to be autonomous in training, fostering, recruiting, and using teachers, and at the same time, there should be policies to attract and retain teachers in difficult-to-recruit subjects,” Ms. Nguyen Thi Bich Thuy proposed.

From the perspective of legal research, Lawyer Le Thi Hang, President of the District 4 Lawyers Association, asked: “Will the promulgation of the Law on Teachers help teachers be honored by society in accordance with their central position and role in education, help teachers live on their salaries, or just put everything related to teachers into a new law?

In case it is necessary to develop and promulgate the Law on Teachers, only include contents of a specific nature and contents that have not been regulated by other laws to avoid duplication, overlap or out of sync, "said Lawyer Le Thi Hang.

Director of the Department of Education and Training of Ho Chi Minh City Nguyen Van Hieu proposed adding regulations allowing localities to proactively implement policies to attract foreign language teachers (specifically English) to increase teacher resources, contributing to the implementation of goals to improve the quality of foreign language teaching and learning in general schools.
