On the afternoon of September 23, continuing the 49th Session, the National Assembly Standing Committee gave opinions on the draft Law on Cyber Security (comprehensive amendments to the Law on Cyber Security and comprehensive amendments to the Law on Network Information Security into one law).
Enhancing self-reliance in cybersecurity
Presenting the Report, Senior Lieutenant General Nguyen Van Long, Deputy Minister of Public Security, said that the draft Law on Cyber Security is expected to regulate activities to protect national security, ensure social order and safety, and protect the legitimate rights and interests of agencies, organizations and individuals in cyberspace; ensure information security and information system safety; and responsibilities of relevant agencies, organizations and individuals.
This Law is expected to apply to Vietnamese agencies, organizations and individuals, foreign organizations and individuals directly participating in or related to cybersecurity protection activities in Vietnam; Vietnamese organizations and individuals, foreign organizations and individuals directly participating in or related to business activities of cybersecurity products and services.
Regarding specific content, the draft adds 1 article regulating data security; adds 1 clause to the article regulating the responsibility of enterprises providing services in cyberspace; adds 1 clause to the article regulating funding for cybersecurity protection. The draft Law also adds provisions on encouraging agencies and organizations in the political system and state-owned enterprises to use Vietnamese security industry products and services that ensure quality standards and regulations to improve autonomy in cybersecurity...
At the meeting, Chairman of the National Assembly's Committee on National Defense, Security and Foreign Affairs Le Tan Toi said that the Standing Committee of the Committee agreed with the necessity of promulgating the law for the reasons stated in the Government's Submission to institutionalize the Party's policies and guidelines on protecting national security, ensuring social order and safety, developing the digital economy, national digital transformation, innovation and international integration; overcoming the overlap and contradiction between the current Law on Cyber Security and the Law on Network Information Security, especially the unclear distinction between network security and network information security;...
At the meeting, National Assembly Chairman Tran Thanh Man emphasized that cyber security is currently a hot topic and is of great concern to the public and the international community. Therefore, the draft law needs to clarify the concepts of cyber security, network information security, cybercrime and important information systems for national security...
The National Assembly Chairman also proposed developing clear criteria to classify and identify important information systems for national security such as banking, energy, transportation, telecommunications systems, etc. At the same time, there should be regulations for periodic assessment and continuous monitoring mechanisms to protect the system from increasingly sophisticated threats.

In addition, build a mechanism to strictly handle violations of privacy rights and illegal collection and use of personal data.
Regarding the scope of regulation, the National Assembly Chairman proposed that the draft law clearly define the affected subjects such as State agencies, enterprises, individuals, foreign organizations operating in Vietnam and regulated behaviors such as cyber attacks, illegal data collection, dissemination of false information, etc.
The National Assembly Chairman also proposed strengthening the role of the Ministry of Public Security, the Ministry of National Defense, and the Ministry of Science and Technology in protecting information systems, and requested clear regulations on sharing data on threats between state agencies and businesses.
Amending and supplementing 10 laws on security and order associated with cutting administrative procedures, decentralization and delegation of power
Also during the meeting, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of 10 laws related to security and order.
Presenting the Government's Report on the draft Law, Deputy Minister of Public Security Nguyen Van Long said that, implementing the provisions of the Law on Promulgation of Legal Documents, the Government submitted to the National Assembly a draft Law amending and supplementing a number of articles of 10 laws related to security and order, including: Law on Security Guards; Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam; Law on Exit and Entry of Vietnamese Citizens; Law on Residence; Law on Identification; Law on Forces Participating in Protecting Security and Order at the Grassroots Level; Law on Road Traffic Order and Safety; Law on Roads; Law on Management and Use of Weapons, Explosives and Supporting Tools; Law on Fire Prevention, Fire Fighting and Rescue according to shortened procedures.

The draft Law consists of 12 articles, institutionalizing and strictly implementing the Party's guidelines and the State's policies on reorganizing the State apparatus, developing science and technology, innovation, national digital transformation, decentralization, delegation of power, and reduction of administrative procedures; ensuring compliance with the Constitution and the unity of the legal system; and ensuring human rights and civil rights.
Presenting the review report, Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi said that the Committee basically agreed on the necessity of promulgating the law; promptly removing difficulties, obstacles, and "bottlenecks" in practice; in line with the development of science, technology, innovation and national digital transformation.
The Committee agreed on the scope of amendments and supplements to 10 laws related to security and order, as they mainly focus on issues related to functions and tasks affected by the arrangement of organizational apparatus, decentralization, and delegation of powers between agencies and levels of government, and the removal of difficulties and obstacles in practice./.
