On December 30, 2024, the Minister of Education and Training issued Circular No. 29/2024/TT-BGDDT regulating extra teaching and learning. The Circular takes effect from February 14, 2025, replacing Circular No. 17/2012/TT-BGDDT dated May 16, 2012 of the Minister of Education and Training promulgating Regulations on extra teaching and learning.
According to Circular No. 29/2024/TT-BGDDT , extra teaching and learning are additional teaching and learning activities outside the prescribed time in the education plan for subjects and educational activities in the General Education Program, the Continuing Education Program at lower secondary level, and the Continuing Education Program at upper secondary level issued by the Minister of Education and Training.
In principle , extra teaching and learning can only be organized when students have the need to learn extra, voluntarily learn extra, and have the consent of their parents or guardians. Schools, organizations, and individuals organizing extra teaching and learning cannot use any form of forcing students to learn extra.
The content of extra teaching and learning must not be contrary to the provisions of Vietnamese law and must not contain prejudices about race, religion, occupation, gender, or social status. The content of teaching according to the school's educational plan must not be reduced to include extra teaching.
Extra teaching and learning must contribute to developing students' qualities and abilities; and must not affect the organization and implementation of the school's educational program and the teachers' implementation of the subject program.
The duration, time, location and form of organization of extra teaching and learning must be suitable for the psychology of the age group, ensuring the health of the students; comply with the provisions of law on working hours, overtime hours and the provisions of law on security, order, safety, environmental sanitation, fire prevention and fighting in the area where extra teaching and learning classes are held .
Cases where extra teaching and learning are not allowed
Article 4 of Circular No. 29/2024/TT-BGDDT clearly stipulates the cases where extra teaching and extra teaching are not allowed:
No extra classes are organized for primary school students, except in the following cases: art training, physical education, and life skills training.
Teachers who are teaching at schools are not allowed to teach extra classes outside of school for money to students that the teacher is assigned to teach by the school according to the school's educational plan.
Teachers at public schools are not allowed to participate in the management and operation of extra-curricular teaching but can participate in extra-curricular teaching.
3 subjects are given extra classes in school
According to the provisions of Article 5, extra teaching and learning in schools must not collect fees from students and is only for students who register for extra classes by subject as follows: Students whose study results for the last subject of the previous semester are not at the standard level; students selected by the school to train excellent students; final year students who voluntarily register for entrance exam review and graduation exam review according to the school's education plan.
The school organizes for students who are eligible to register for extra classes for each subject in each grade. Based on the number of registered students, the school builds a plan to organize extra classes for each subject in each grade.
Tutoring classes are arranged by subject for each grade level; each class has no more than 45 students.
Each subject is organized to teach no more than 2 periods/week.
Plans for organizing extra teaching and learning are made public on the school's website or posted at the school.
Extracurricular tutoring organizations that collect fees from students must register their business.
Article 6 of the Circular regulating extra-curricular teaching and learning outside of school clearly states that organizations or individuals organizing extra-curricular teaching and learning activities outside of school that collect fees from students must comply with the following requirements:
Register business according to the law;
Publicly announce on the electronic information portal or post at the location of the tutoring facility the subjects that are organized for tutoring; the duration of tutoring for each subject according to each grade level; the location, form, and time of organizing tutoring and learning; the list of tutors and the tuition fees before enrolling students for tutoring and learning classes.
Extracurricular tutors must have good moral qualities and professional qualifications appropriate to the subjects they teach.
Teachers who are teaching at schools and participate in extracurricular teaching must report to the Principal, Director, or head of the school about the subjects, location, form, and time of extracurricular teaching.
Collect and manage tuition fees
Funding for organizing extra teaching and learning in schools uses the state budget and other legal funding sources according to the provisions of law.
The level of tuition for extra-curricular study outside of school is agreed upon between the student's parents, the student and the tutoring facility.
The collection, management and use of tuition fees shall comply with the provisions of the law on finance, budget, assets, accounting, taxes and other relevant regulations.
Schools, tutoring facilities, organizations and individuals violating regulations on tutoring and learning, depending on the nature and severity of the violation, will be handled according to the provisions of law.
Heads of agencies, organizations and units whose cadres, civil servants and public employees violate regulations on extra teaching and learning, depending on the nature and seriousness of the violation, shall be handled according to the provisions of law.
Along with the promulgation of legal regulations, in recent times, the Prime Minister and the Minister of Education and Training have also issued many directive documents on the management of extra teaching and learning activities; most recently, Official Dispatch No. 10/CD-TTg dated February 7, 2025 of the Prime Minister on strengthening the direction of junior high school enrollment, high school enrollment and the management of extra teaching and learning activities.
In particular, the Prime Minister directed the Chairmen of the People's Committees of provinces and centrally-run cities to focus on directing the synchronous and effective implementation of tasks and solutions and take full responsibility for the work of junior high school enrollment, high school enrollment and management of extra teaching and learning activities in the area. Direct general education institutions in the area to strictly implement regulations on extra teaching and learning; strictly handle cases of violations of regulations. Timely detect, commend, reward, and promote examples of collectives and individuals who are dedicated, enthusiastic, and devoted to students. Provide appropriate financial support to schools to contribute to improving the quality of education.
Implementing the Prime Minister's telegram, dated February 8, 2025, the People's Committee of Bac Kan province issued Official Dispatch No. 840/UBND-VXNV directing the Department of Education and Training and the People's Committees of districts and cities according to their functions, tasks and authority to advise and focus on directing the synchronous and effective implementation of tasks and solutions on enrollment and management of extra teaching and learning activities.
The Department of Education and Training prepares well the conditions for organizing junior high school and high school admissions to ensure transparency, practicality, efficiency, reduce pressure, and reduce costs for society; completes the announcement of junior high school and high school admissions plans for the 2025-2026 school year in February 2025 so that students, teachers, schools, and general education institutions can proactively prepare for admissions.
Direct general education institutions to strictly implement regulations on extra teaching and learning; strengthen information, propaganda, inspection and examination of the implementation of junior high school and high school enrollment and management of extra teaching and learning activities; strictly handle and publicize violations according to regulations. Timely detect, commend, reward and promote collective and individual examples of dedication, enthusiasm and devotion to students./.
