According to the Decree, an electronic labor contract is a contract concluded and established in the form of data messages in accordance with the provisions of labor law and the law on electronic transactions. An electronic labor contract has the same legal validity as a labor contract drawn up in paper form.

The conclusion and execution of electronic labor contracts must fully comply with the provisions of labor law, electronic transactions, network information security, data, personal data protection, storage, as well as the specific regulations in Decree No. 337/2025/ND-CP. This is a requirement to ensure the legality, safety, and confidentiality of information throughout the contract establishment and execution process.
The decree clearly stipulates that electronic labor contracts must be sent to both employees and employers in the form of data messages via appropriate electronic means, based on the agreement of the parties. The storage, retrieval, and use of the contract must ensure its integrity, authenticity, and retrievability when needed.
Notably, the Decree encourages employers to adopt electronic labor contracts instead of paper-based labor contracts in human resource management as well as in handling administrative procedures related to labor contracts. This is considered an important step to reduce costs, save time, and improve management efficiency in the context of the accelerated national digital transformation.
Regarding the participating parties, the Decree identifies the following: employees; employers authorized to conclude labor contracts as stipulated in Article 18 of the Labor Code; and providers of electronic contract services (eContracts) that fully meet the conditions prescribed by law.
Decree No. 337/2025/ND-CP takes effect from January 1, 2026. The electronic labor contract platform must be operational no later than July 1, 2026. From this point onwards, the conclusion and implementation of electronic labor contracts will be carried out synchronously according to the Decree's regulations, ushering in a new phase in the modernization of labor management in Vietnam.
