On the afternoon of May 10, continuing the 9th session, the National Assembly discussed in groups the draft law on Amending and supplementing a number of articles of the Law on Planning.
'Foreign countries plan long-term, not every 5-10 years and then revise'

Speaking at the discussion, National Assembly Chairman Tran Thanh Man said the Planning Law was issued in 2017, after which the Government, ministries, branches and localities issued documents to guide and implement it, but "up to now many issues are still stuck".
However, according to the National Assembly Chairman, this amendment to the Planning Law is not a comprehensive amendment but aims to perfect the planning system, serve the arrangement and merger of administrative units, and build a two-level local government.
The requirement is to amend the Planning Law to be appropriate, especially to promote decentralization and delegation of power, to avoid the situation like recently, when the list of projects was decided by the National Assembly but localities still had to work with ministries and branches to request changes to land use planning.
The National Assembly Chairman also emphasized that planning must ensure transparency and consistency. It is necessary to regulate public information about planning and collect real opinions from the people, especially those directly affected by the planning. In addition, a monitoring mechanism must be established to ensure that planning is not arbitrarily adjusted for local interests.
"Comrades who go abroad see a city or province that has a planning model, an exhibition, and people can come in and see it. They plan this long-term, not to be revised every 5-10 years. In many localities in our country, the secretary and chairman of this term plan like this, but in the next term, the next secretary and chairman come in and change and supplement it," the National Assembly Chairman said, and emphasized that if there is no transparency and consistency, it will lead to a situation where the planning is constantly changed.
"This is an issue that we must consider carefully. When implementing planning, it is necessary to strengthen the enforcement and monitoring mechanism. If the planning is transparent, public, supervised by the people, and the people agree, then I think that the implementation of the planning will be good and feasible," said the National Assembly Chairman.
The National Assembly Chairman noted that decentralization and delegation of power must be strict, ensuring the National Assembly's right to decide and supervise resources of national importance.

"Fix anything but make sure it is not unconstitutional"
Regarding decentralization and delegation of power in planning, appraisal, approval, implementation and adjustment, the National Assembly Chairman emphasized the need for strong innovation to implement stronger decentralization and delegation of power according to the Party's policy.
The National Assembly Chairman said that in this draft law, it is expected to decentralize the authority of the National Assembly to the Government in determining areas that need planning, deciding on national marine spatial planning, and national land use planning.
At the same time, many of the Prime Minister's authorities will be decentralized to ministers and chairmen of provincial and municipal People's Committees, such as deciding on the list of priority investment projects in the implementation plan of sectoral, national and provincial planning; or adjusting sectoral and provincial planning for the 2021-2030 period.
The National Assembly Chairman proposed to specifically assess practical difficulties in implementing the authority to decide, approve or adjust planning in order to make amendments.
"Previously, some National Assembly resolutions have been adjusted but they have not been implemented yet. If we issue laws and resolutions, if they are stuck or blocked somewhere, we must step in to fix them. This law is not issued by the National Assembly anywhere or abroad," said the National Assembly Chairman.
At the same time, the National Assembly Chairman noted that when decentralizing the decision on national land use planning and national marine spatial planning to the Government, it is necessary to study and integrate some important contents of these two plans into the content of the national master plan. This is to ensure the National Assembly's right to supervise and decide on resources of national importance. "Any amendment must be made without violating the Constitution and in compliance with the Constitution," the National Assembly Chairman stated.
Regarding the shortening of the planning adjustment process by simplifying the steps, eliminating the need to carry out procedures for requesting approval for planning adjustment or strategic environmental assessment, the National Assembly Chairman said that it would help speed up the progress. However, it is necessary to consider adjustments that change the scale and content significantly.
"For example, changing the development orientation of land use goals without strategic environmental assessment will have a negative impact on the environment, posing risks to sustainable development. Whatever is said, planning must ensure airspace, sea areas, national defense, security, and the environment," said the National Assembly Chairman, and requested the reviewing agency to review and clarify which cases must be submitted to the National Assembly and which cases must be submitted to the National Assembly Standing Committee for consideration.
