Regulations on revocation of driving license
Pursuant to Clause 1, Article 25 of the 2012 Law on Handling of Administrative Violations, as amended by Clause 11, Article 1 of the 2020 amended Law on Handling of Administrative Violations, the revocation of a driving license is an arbitration measure applied to individuals or organizations that seriously violate traffic safety regulations. This measure takes effect immediately and lasts for a period of time prescribed by the competent authority. During the period of revocation of the driving license, the violator is not allowed to drive any vehicle within the scope of the revoked driving license.
Can I retake my driving test after my license is revoked?
According to Clause 5, Article 81 of Decree 100/2019/ND-CP, during the period of suspension of the right to use a driving license, the violator is not allowed to carry out procedures for granting, exchanging, or retaking the driving license. This is to ensure that measures to handle traffic violations are effectively implemented, minimizing the risk of accidents caused by incompetent or non-compliant people. Thus, if the traffic police revoke the driving license, it is impossible to give up the license to retake the test during the suspension period.
Purpose of driver's license revocation
Revoking a driver's license is not only a form of punishment but also has many important purposes:
1. Deterrence: Create strong barriers to prevent repeat violations, especially for serious violations. Violators will be more aware of the seriousness of their behavior and the potential harm, thereby changing their traffic habits.
2. Education: Having your driver's license revoked helps offenders realize their mistakes, raise their sense of responsibility and compliance with traffic laws. At the same time, encourage them to attend traffic safety courses to improve their knowledge and driving skills.
3. Ensuring traffic safety and order: Minimizing traffic accidents, protecting the health and lives of road users. At the same time, reducing the number of vehicles on the road can help solve the problem of traffic congestion, especially in big cities.
4. Ensure the safety of the offender: In some cases, revoking a driver's license can protect the offender, especially if they have health or mental problems that make them unable to drive safely.
5. Encourage the use of public transport: Offenders who have their driving licenses revoked will have to look for other means of transport, such as buses, motorbike taxis, or taxis. This can help promote the use of public transport, reducing congestion and environmental pollution.
In summary, revoking a driver's license is a strict penalty, but also a responsible measure in ensuring traffic safety and raising public awareness. However, the application of this form of penalty must be carried out fairly, objectively and in accordance with the provisions of the law, and at the same time, there must be a careful assessment of the impact on the violator and society. Each individual needs to raise awareness of obeying traffic laws to avoid being punished and contribute to building a safer traffic environment.
