Proposal to mobilize retired teachers to advise on educational activities at the commune level

The Ministry of Education and Training requested the People's Committees of provinces to direct the reasonable allocation of civil servants at provincial and commune levels; review the team of civil servants at commune level in charge of culture and society , ensuring the right people are assigned with the right qualifications.

Along with that, there are appropriate solutions to mobilize civil servants who previously worked at the Department of Education and Training or receive and second educational managers and teachers at all levels with appropriate expertise and experience to arrange them to be in charge of the field of education and training at the commune level if they meet the prescribed conditions.

The Ministry recommends that provinces consider establishing commune-level education advisory councils and groups of key management staff to support educational activities. Members include management staff, current or retired teachers. These groups operate part-time, without creating additional administrative units.

In addition, the Ministry directed the Department of Education and Training to preside over and coordinate with relevant departments and branches to proactively grasp difficulties and obstacles in the field of education and training when implementing two-level government, promptly find solutions to remove them or report to competent authorities to remove them. Organize training and fostering for the team of commune-level civil servants in charge of the field of education and training, ensuring that there are no gaps or overlaps in management content, and that management content and methods are clear.

Innovate education management methods from administrative to creative, empowering and supporting development; shift from pre-control to appropriate post-control. At the same time, promote digital transformation, equip information technology skills and apply artificial intelligence to commune-level civil servants.

While the documents guiding the implementation of the Law on Teachers have not yet taken effect, the Ministry of Education and Training also requests the Provincial People's Committee and the Chairman of the Provincial People's Committee to consider and decide to assign the Department of Education and Training to preside over the recruitment, reception, mobilization, secondment, and transfer of teachers and staff in educational institutions in the province.

According to the Ministry of Education and Training, Clause 10, Article 23 of the Law on Organization of Local Government stipulates the duties and powers of the Chairman of the Commune People's Committee: "Directing and organizing the implementation of the work of recruiting, using, and managing civil servants and public employees in the area according to the provisions of law and decentralization of higher-level state agencies". Accordingly, the Chairman of the Commune People's Committee only recruits and uses civil servants when decentralized.

The Ministry of Education and Training believes that, in the context that the number of commune-level civil servants in charge of education and training is currently lacking, and many people do not have experience in state management of education, decentralization to the Department of Education and Training to preside over the recruitment, reception, mobilization, secondment, and transfer of teachers and staff in educational institutions in the province is appropriate to the current conditions and capacity of the department.

Assigning the Department of Education and Training to preside will help reduce intermediaries, synchronize recruitment quality, save costs and increase opportunities for candidates. At the same time, it will contribute to overcoming the surplus and shortage of teachers and staff and ensure the structure of the team according to grade level and subject.

The Ministry of Education and Training requests the provincial People's Committees to maintain stability and ensure the staff, employees and workers in educational institutions to prepare for the new school year. Direct the recruitment of teachers and solutions to ensure the staff and staff of preschool and general education. In cases where recruitment has not been made, it is possible to consider, arrange funding and sign labor contracts or mobilize, second, and arrange inter-school and inter-level to ensure sufficient staff for the new school year.

Along with that, the Ministry requested the Provincial People's Committee to pay attention and promptly direct the implementation of replacement contracts for cases of sick leave, maternity leave, retirement, resignation or contracts within the payroll quota, unused labor contract quota to ensure the addition of teachers, staff and workers lacking in educational institutions.
