The Ministry of Home Affairs has just submitted to the Ministry of Justice for appraisal a draft decree detailing a number of articles of the Law on Employment on policies to support job creation.
A notable new point is the addition of regulations on working hours, rest breaks and overtime pay for employees participating in public employment.
Accordingly, working hours shall not exceed 8 hours per day; each week shall be entitled to at least one day off (24 consecutive hours). In special cases due to the work cycle, employees shall be entitled to an average of at least 4 days off per month.
In case of overtime, the total number of working hours and overtime shall not exceed 12 hours per day. Overtime wages are calculated at the minimum rate: at least 150% of salary on weekdays, 200% on weekly rest days, and 300% on holidays and Tet. These rates inherit and specify the provisions of labor law.
Community workers are a group of workers who directly participate in projects, works, and activities carried out by the community, often with state funding, such as building rural roads, dredging canals, and cleaning the environment. They do not sign long-term labor contracts like workers in enterprises, but receive daily/hourly wages from the project.
