(NLDO)- On February 7, continuing the 42nd session, the National Assembly Standing Committee gave opinions on a number of major issues regarding the reception, explanation, and revision of the draft Law on Teachers.
Regarding some major issues of the draft, Mr. Nguyen Dac Vinh, Chairman of the National Assembly's Committee on Culture and Education , said that regarding the authority to recruit teachers, many opinions agreed with the regulation assigning the authority to recruit teachers to the education sector, but requested clarification of the agency that is decentralized and authorized to recruit.

The Standing Committee of the Culture and Education Committee believes that delegating recruitment authority to the education sector is necessary, both to ensure the authenticity of recruitment and to enhance responsibility and create conditions for the sector to be proactive in recruiting, using, managing and developing teachers, meeting the requirements on quantity, structure and quality; contributing to overcoming the situation of local surplus, shortage and imbalance in the structure of teachers.
In response to the opinions of National Assembly deputies, the draft law is adjusted in the direction that for autonomous public educational institutions, the head of the educational institution will carry out the recruitment. For non-autonomous public educational institutions, the educational institution management agency will carry out the recruitment of teachers or delegate the responsibility to the educational management agency, and the head of the educational institution will carry out the recruitment.
Opinions at the meeting agreed with the revised content, saying that the regulation in this direction affirms the role and responsibility of presiding over and advising the education management agency; ensuring consistency with the provisions of the Law on Organization of Local Government, the Law on Public Employees and the Labor Code.
Regarding this content, Vice Chairman of the National Assembly Tran Quang Phuong also supports decentralization and delegation of power to educational institutions, including autonomous or non-autonomous institutions. "Whether public educational institutions are autonomous or non-autonomous, the educational institutions should be the ones with the right to recruit, the educational management agency should not interfere" - Vice Chairman of the National Assembly said and clearly stated that the management agency is to make policies, inspect, and examine, if recruitment violates regulations, they will "blow the whistle".
Regarding regulations related to the mobilization and transfer of teachers, Vice Chairman of the National Assembly Tran Quang Phuong said the draft law stipulates that transfers must be accepted by three places: the place of departure, the place of destination, and the education management agency.
The Vice Chairman of the National Assembly said that there should be clear regulations on this issue to remove the current bottlenecks in the mobilization and transfer of teachers. He mentioned that a number of teachers in ethnic minority areas, mountainous areas, border areas, islands and areas with particularly difficult socio-economic conditions for 3 years or more are allowed to be transferred when the destination agrees to accept them.
However, in reality, many places use the excuse of having enough staff to not accept teachers, leading to the situation where some teachers have been working in remote areas for 10-20 years, but still have to work in remote areas.
According to the Vice Chairman of the National Assembly, the mobilization and transfer should be assigned to the superior management agency. The State has the right to mobilize teachers who have worked for 3 years in mountainous, remote and isolated areas to places with better conditions or vice versa.
At the same time, he emphasized that the state management agency's transfer of teachers from the lowlands to the highlands is a must, like the army, you have to go. "You are a state employee, if you don't go, you will quit your job. We give preferential treatment but there must be strict discipline" - the Vice Chairman of the National Assembly said.
Explaining this issue, Minister of Education and Training Nguyen Kim Son stated that the education sector "wants" strong and appropriate policies in mobilizing and transferring teachers. However, this is also very different from the military's mobilizing, because the education sector currently does not manage civil servants but delegates that to the provincial level.
Minister Nguyen Kim Son assessed that the draft law proposing to assign the department level to mobilize between regions in the whole province is a revolutionary change. "If the education sector were assigned to manage civil servants as in the army, it would do well, but at present it is not as good as the army" - the head of the Ministry of Education and Training emphasized.
The Draft Law on Teachers is expected to be considered and approved by the National Assembly at the 9th session in May 2025.
