Minister Nguyen Van Thang explains the reason for abolishing lump-sum tax from 2026 for business households

The Ministry of Finance is guiding business households to register and declare taxes, increase technology application to reduce cost burden, and encourage business households to convert to enterprises.

On the morning of May 16, explaining to the National Assembly the draft resolution of the National Assembly on mechanisms and policies for private economic development, Minister of Finance Nguyen Van Thang said that the regulations and policies stated in the draft resolution aim to institutionalize the contents of Resolution 68/ Political Bureau.

Many outstanding policies for businesses

Many of these policies are superior to business households and individual businesses, which are stipulated in the draft resolution. Some contents are currently stipulated in other laws and resolutions such as inspection, examination, bankruptcy settlement, handling of violations, etc.

With the policy of abolishing lump-sum tax for business households from January 1, 2026, many delegates are concerned that it will create a compliance burden when they have to declare and register for taxes... Mr. Thang affirmed that this is the right policy, creating equality and encouraging business households to transform into enterprises.

The Ministry of Finance is piloting this policy in some localities and has found it effective and needs to be officially implemented soon. The Ministry is also directing tax authorities to guide business households in registering and declaring taxes, increasing the application of technology to reduce the burden of costs, and encouraging business households to transform.

With the support program for medium and large enterprises and regional and international private economic groups mentioned in the draft resolution, resources will be evaluated during the construction process to ensure feasibility and effectiveness.

Tax and fee policies are also built on the spirit of nurturing revenue sources. Therefore, Minister Thang believes that in the short term, revenue sources may decrease, but in the long term, these policies will help businesses have more resources and contribute more to the budget.

Expressing his opinion earlier, delegate Tran Hoang Ngan (HCMC) highly appreciated the efforts of the National Assembly Standing Committee and the Government to promptly institutionalize the Party's policy and Resolution 68 of the Politburo on private economic development.

"This resolution is of particular importance as the country is accelerating its development into a new era. The private economic sector accounts for 51% of GDP and contributes 33% of total state budget revenue, so it needs many special support mechanisms to promote its role as the most important driving force by 2030," Mr. Ngan emphasized.

The draft resolution sets a target of 2 million businesses by 2030. Mr. Ngan said that to achieve this target, there must be special solutions. Also because currently, each year only increases about 30,000-40,000 businesses, so in order to reach 2 million businesses in 5 years, there must be policies to support individual business households to become businesses.

How to have 2 million businesses in the next 5 years?

According to delegate Tran Anh Tuan (HCMC), in principle, legal regulations cannot be applied retroactively to deal with disadvantages for businesses, business households, and business individuals.

According to Mr. Tuan, there were previously regulations that were beneficial to businesses, so it is necessary to study the possibility of "retroactively" using these beneficial regulations to remove obstacles, difficulties, and bottlenecks for businesses in the past when the law was unclear.

Delegate Tran Van Tuan (Bac Giang) highly appreciated the draft stating the principle for violations and cases related to civil and economic matters, giving priority to applying civil, economic and administrative measures first; enterprises, business households and business individuals are proactive in overcoming violations and damages.

In cases where the practical application of the law may result in criminal proceedings or no criminal proceedings, criminal proceedings shall not be applied. For violations that are subject to criminal proceedings, priority shall be given to proactive, timely and comprehensive measures to remedy economic consequences.

According to the delegate, this is an important basis for the prosecution agency to consider when deciding to initiate, investigate, prosecute, try and take further measures. However, to ensure consistency, it is necessary to amend and supplement related laws.
