Ministry of Health responds to voters' petitions before the 9th Session of the 15th National Assembly (continued and end)

Voters reflect that currently, the price of medical examination and treatment services has not been calculated correctly and fully, including depreciation, maintenance, training costs, etc. It is recommended that the Ministry of Health and relevant ministries and branches rebuild service prices to ensure operations at medical facilities.

Pursuant to the Law on Medical Examination and Treatment (MBT) 2023, the price of MBT services is determined based on four cost factors: direct costs, wages, management costs and depreciation costs. Currently, the MBT price only calculates two factors: direct costs and wages, excluding management costs and depreciation.

Adjusting health insurance prices needs to be careful, according to a roadmap, based on the assessment of the consumer price index (CPI) to ensure reasonable price adjustment, control inflation, stabilize the macro economy , support the roadmap for universal health insurance and be suitable for people's ability to pay as well as balance the Health Insurance Fund.

Pursuant to Clause 3, Article 110 of the Law on Medical Examination and Treatment and Clause 6, Article 119 of Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government detailing a number of articles of the Law on Medical Examination and Treatment, the Ministry of Health shall coordinate with relevant ministries and branches to report to competent authorities for decision on price adjustment. Currently, the Ministry of Health is coordinating to assess the impact to propose an appropriate time to include management costs in the price of medical examination and treatment.

Regarding pricing authority, according to Point d, Clause 3, Article 108, Clauses 5, 6, 7, Article 110 of the Law on Medical Examination and Treatment and Clause 9, Article 119 of Decree No. 96/2023/ND-CP, the Ministry of Health and the Provincial People's Council approve the price of medical examination and treatment services for facilities under their authority, based on the price plan dossier developed by the units. The Ministry of Health does not regulate the price of medical examination and treatment services for all medical facilities nationwide.

4. Voters suggest that it is necessary to increase investment in healthcare activities (investment in purchasing medical equipment) to develop high-tech services and techniques that are in great demand for patients (such as hemodialysis...).

Pursuant to Resolution No. 43/2022/QH15 dated January 11, 2022 of the National Assembly on fiscal and monetary policies to support the Socio-Economic Recovery and Development Program and Resolution No. 11/NQ-CP dated January 30, 2022 of the Government on the Socio-Economic Recovery and Development Program, the Ministry of Health has allocated funds to participating units in the program in accordance with regulations.

Specifically, on March 8, 2023, the Prime Minister issued Decision No. 202/QD-TTg assigning the capital plan for the Socio-Economic Recovery and Development Program in the health sector, in which Dak Lak province was allocated a total capital of 286 billion VND for the Project to invest in construction and purchase equipment for the Center for Disease Control (CDC) of Dak Lak province.

Voters request the Ministry of Health to review the current policy of treatment for doctors in particular and medical staff in general at the grassroots level, which is not suitable, so the recruitment of doctors, especially specialist doctors to work at the grassroots level is not attractive, leading to difficulties.

Currently, in addition to the salary regime according to Decree No. 204/2004/ND-CP, dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces and guiding documents, amendments and supplements; cadres and public employees in the health sector are entitled to allowances such as preferential allowances according to profession, special allowances, toxic and dangerous allowances, allowances for areas with particularly difficult socio-economic conditions and special allowances at some hospitals, or for village health workers.

To encourage medical staff working in primary health care and preventive medicine, Decree No. 05/2023/ND-CP dated October 15, 2023 amends and supplements Decree No. 56/2011/ND-CP stipulating a 100% preferential allowance for preventive medicine and primary health care staff from January 1, 2022 to December 31, 2023.

In addition, some localities have issued Resolutions of the Provincial People's Council stipulating a number of specific expenditure contents and levels for medical staff in the area to attract medical staff to work at grassroots health facilities and in the field of preventive medicine.

Regarding policy reform, the Ministry of Health is proposing to assign level 2 salaries to the positions of doctors, preventive medicine doctors, and pharmacists when recruiting. At the same time, the Ministry is developing a Decree to replace Decree No. 56/2011/ND-CP on preferential allowances by profession (expected to be completed in December 2025) and a Decree regulating special allowances, anti-epidemic allowances, and support for village health workers (expected to be completed in September 2025).

Regarding seniority allowance, according to Resolution No. 27-NQ/TW dated May 21, 2018 of the Central Executive Committee, this regime has been abolished for the health sector to ensure salary correlation. The Ministry of Health hopes to receive the understanding and consensus of voters on current policies.
