From July 1, 2024, the 2023 Law on Identification will officially come into effect. In particular, the Law on Identification assigns the Government to specify a number of contents to ensure the organization and implementation of the work.
According to Lao Dong's research, the Ministry of Public Security is currently drafting a Decree detailing a number of articles and measures to implement the Law on Identification. The Ministry of Justice has also just published documents assessing this draft Decree.
Article 19 of the draft Decree stipulates the integration of information into identity cards and the use and exploitation of integrated information.
Accordingly, the information integrated into the ID card includes information from the types of documents specified in Clause 2, Article 22 of the Law on Identification or licenses, certificates, certifications, and other documents issued by competent authorities to citizens with photos and personal information attached as prescribed by law.
Information on documents integrated into the ID card is shown in character form, including all information on the documents that have been authenticated with the national database, specialized database and updated, synchronized into the National Population Database to transfer to the ID production, issuance and management system to integrate information into the ID card.
The exploitation and use of information integrated in the ID card must be agreed by the citizen through authentication and comparison of facial photos and fingerprints using specialized equipment.
According to Article 22 of the Law on Identification, information integrated into the identification card includes information on health insurance cards, social insurance books, driver's licenses, birth certificates, marriage certificates or other documents decided by the Prime Minister, except for information on documents issued by the Ministry of National Defense .
The use of information integrated into the identity card has the same value as providing information or using documents containing that information in performing administrative procedures, public services, transactions and other activities.
Exploitation of integrated information encoded in the identity card is regulated as follows: Using specialized equipment to exploit integrated information in the encrypted storage part of the identity card;
State agencies, political organizations, and socio-political organizations are allowed to exploit integrated information encoded in identity cards to perform assigned functions and tasks...
Speaking with Lao Dong on the afternoon of March 26, Lawyer Dang Van Cuong (Hanoi Bar Association) said that currently, citizens have many different types of documents, such as citizen identification cards, health insurance cards, social insurance cards, driver's licenses, vehicle registration papers, various degrees, certificates, etc.
Therefore, integrating these documents into the ID card will help reduce paperwork for citizens, facilitate citizens in performing civil transactions, implementing digital transformation, and reforming administrative procedures.
