Photo: Pham Dong On the afternoon of October 22nd, continuing the 8th session, the Chairman of the National Assembly's Committee on National Defense and Security, Le Tan Toi, reported on the review of the draft Law on Data. Regarding the provision of data to Party and State agencies and socio- political organizations, Mr. Le Tan Toi stated that the Committee on National Defense and Security basically agreed with the provisions of the draft law. However, he requested that measures be stipulated to ensure the information security of organizations and individuals when implementing these regulations. The Committee on National Defense and Security basically agreed on the provision regarding the National Data Development Fund as a non-budgetary state financial fund, established at the central level to mobilize social resources to support the construction and development of national data. Some opinions suggested clarifying the financial sources forming the fund; clearly defining which activities are funded from the state budget and which are funded from the fund, ensuring clarity and transparency. Some opinions suggest considering and clarifying the legal and practical basis for establishing the fund; and suggesting that the fund's expenditure items be carefully considered to ensure compliance with the law on state budget and other relevant laws. However, some opinions suggested clarifying the resources to ensure the collection, updating, and synchronization of data into the National Comprehensive Database. Regarding fees for accessing and using information in the National Comprehensive Database and other databases managed by state agencies, the Committee generally agreed with the provisions in Article 39 of the draft law, aiming to create a financial source for investment and support in the construction and management of the National Comprehensive Database and other databases managed by state agencies. Some opinions suggested researching the addition of a provision allowing other organizations and individuals to access data free of charge based on contributions and data provision to these databases, in order to encourage entities to provide and share data to create a rich and comprehensive data source. The National Assembly's Committee on Legal Affairs basically agreed with the regulations on data-related products and services, the data market, and data exchanges in the draft law. Mr. Le Tan Toi stated that some opinions suggest these contents are already regulated by several related laws such as: the Law on Electronic Transactions, the Law on Cybersecurity, the Law on Network Information Security, the Law on Telecommunications, and especially the draft Law on Digital Technology Industry. Therefore, it is suggested that the relationship between the provisions of this draft law and the provisions of existing laws and the draft Law on Digital Technology Industry be clarified to define the scope of regulation appropriately and avoid overlap. Another opinion suggests that this is a new and unique field, and to ensure strict management and security, a pilot application of a data exchange could be considered. Therefore, it is not necessary to regulate too much detail in this law; instead, the Government should organize the pilot implementation and report to the National Assembly.
