That was the conclusion of Vice Chairman of the National Assembly , Senior Lieutenant General Tran Quang Phuong at the 50th session of the National Assembly Standing Committee, giving opinions on the draft Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization on October 14.

Presenting the Draft Law on amending and supplementing a number of articles of the Law on Defense Industry, Security and Industrial Mobilization, Deputy Minister of Public Security Le Quoc Hung said that the draft Law was built to synchronously complete the legal system, mechanisms, and policies, creating an environment for the development of security industry to serve the entire political and social system, aiming at export, actively contributing to the cause of industrialization, modernization, and national digital transformation.
At the same time, issue appropriate and specific mechanisms and policies to serve the strong development of the security industry. The Law Project focuses on amending and supplementing contents according to the direction of competent authorities, focusing on regulations on the formation of the National Security Industrial Complex and the establishment of the Security Industry Development Investment Fund.
The Draft Law adds 1 section on the National Security Industrial Complex to Chapter II, including 4 Articles, regulating the functions, tasks, and composition of the National Security Industrial Complex (Article 45a), the core of the National Security Industrial Complex (Article 45b), members participating in the National Security Industrial Complex (Article 45c) and the State's policy towards the National Security Industrial Complex.
“The basic supplementary content is similar to the regulations on the National Defense Industrial Complex in Section 7, Chapter II. However, it specifically stipulates the specific contents of the National Security Industrial Complex compared to the National Defense Industrial Complex to avoid duplication, overlap and institutionalize the Politburo's requirements on the National Security Industrial Complex,” the Deputy Minister of Public Security affirmed.
The draft Law also amends and supplements relevant provisions in the Law on Defense Industry, Security and Industrial Mobilization to separate the Defense Industry Fund into two independent Funds, including the Security Industry Development Investment Fund and the Defense Industry Fund. In which, the Security Industry Development Investment Fund is a venture investment to build and develop the security industry.
Because the General Fund is not used, according to the Deputy Minister of Public Security, the draft Law decentralizes the management of the National Defense Industry Fund from the Government to the Ministry of National Defense, assigning the Ministry of Public Security to manage the Security Industry Development Investment Fund. In addition, it supplements a number of specific provisions of the Security Industry Development Investment Fund, including financial resources from contributions of members participating in the National Security Industry Complex, principles of risk-taking operations, and venture capital to build and develop the security industry. In particular, it does not specify the principle of non-duplication of expenditure content with the National Defense Industry Fund and the National Data Development Fund.
Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi said that the National Defense, Security and Foreign Affairs Committee agreed with the additional regulations on the Security Industry Development Investment Fund in the draft Law to promptly institutionalize Conclusion No. 158-KL/TW of the Politburo with specific mechanisms, accepting risks, and being allowed to invest in related activities to build the security industry; agreed with the proposal to adjust the name of the "Defense and Security Industry Fund" to "Defense Industry Fund" to separate it into two separate funds: the Defense Industry Fund and the Security Industry Development Investment Fund.
The Committee on National Defense, Security and Foreign Affairs also basically agreed with the content of Article 45a on the functions, tasks and composition of the National Security Industrial Complex. In addition, there were opinions suggesting reviewing the security industrial products and services listed in Point a, Clause 2 for completeness or general regulations to ensure flexibility; suggesting adding a specific provision on the "National Security Industrial Development Management Council" or assigning the Government to specify regulations on this Council.
The Government proposed to draft a Law on amending and supplementing a number of articles of the Law on Defense Industry, Security and Industrial Mobilization following a shortened order and procedure to submit to the National Assembly for comments and approval at the 10th Session. However, since most of the amended and supplemented contents are assigned to the Government for detailed regulations, the Chairman of the Committee on Defense, Security and Foreign Affairs suggested considering the appropriate time for the law to come into effect.
Members of the National Assembly Standing Committee agreed on the necessity of amending and supplementing the Law on Defense Industry, Security and Industrial Mobilization; basically agreed with many contents in the draft Law submitted by the Government and the review report of the Committee on National Defense, Security and Foreign Affairs.

Concluding this content, Vice Chairman of the National Assembly Tran Quang Phuong suggested that the Government continue to review the Party's policies, guidelines and viewpoints on the defense industry and security industry, especially Conclusion No. 158-KL/TW of the Politburo, to ensure full and comprehensive institutionalization in the draft Law. This is to meet the urgent needs of the practical situation of developing the security industry system, forming the Security Industry Complex, establishing the Security Industry Development Investment Fund and building appropriate outstanding mechanisms and policies.
The Vice Chairman of the National Assembly also proposed that the Government should provide detailed regulations for both the defense and security sectors; and study the management and operation mechanism of the Security Industry Complex for efficiency and feasibility. The Law was developed and promulgated following a simplified procedure, so it can take effect from the date of approval or the date of signing. Therefore, the Vice Chairman of the National Assembly suggested that the Government direct ministries and branches to promptly complete detailed documents guiding the implementation so that they have the same effect as the law. Limit the late issuance of documents guiding the implementation because this Law project stipulates many new issues of a constructive and developmental nature.
