However, whether the above resolutions will quickly and smoothly enter life or not depends largely on the speed and quality of law-making at the 9th session of the 15th National Assembly, currently taking place in Hanoi . Of course, it is not until now that the institutionalization of important directions of the Central Committee has been prepared, but a series of draft laws and resolutions have been urgently built and completed over the past time.
First of all, it is necessary to mention the amendment and supplementation of a number of articles of the 2013 Constitution. In practice, the existence of many small-scale administrative units disperses resources, fails to promote the advantages and potentials of localities for socio -economic development, causing difficulties in planning, rational, economical and effective use of resources for socio -economic development of the country.
In that context, amending and supplementing a number of articles of the 2013 Constitution at present is extremely necessary, creating a constitutional basis for implementing the revolution in streamlining the organizational apparatus, building, perfecting and improving the operational efficiency of the political system, meeting the requirements and tasks of rapid and sustainable national development.
Along with the Constitution, a series of draft laws that are the “pillars” of the economy will be submitted to the National Assembly for consideration and approval with many strong changes. A fairly clear example is the draft revised Enterprise Law, which stipulates the use of personal identification and organizational identification to replace all traditional documents in business registration, thereby helping to reduce the paperwork that businesses and individuals must submit and simplify the information that businesses must declare to the business registration agency.
Regarding corporate governance, this draft law amends 14 contents and adds 7 contents in the direction of strengthening the "post-audit" responsibility of agencies and local authorities in state management of enterprises. Minister of Finance Nguyen Van Thang affirmed before the National Assembly Standing Committee (NASC) that these adjusted and supplemented regulations do not create administrative procedures and reduce compliance costs for enterprises.
The draft Law amending and supplementing a number of articles of 7 laws: Investment, Enterprises, Bidding, Land, Public Investment, Investment under the Public-Private Partnership (PPP) method and Management and Use of Public Assets is expected to be passed by the National Assembly at the 9th session, creating conditions for the Government to be flexible in its operations, while businesses can quickly benefit from new policies. In particular, the draft Law on PPP adds provisions allowing individual investors to participate in PPP projects; allows the application of BOT contracts to projects to upgrade and expand works; adds cases of early termination of PPP project contracts when commercialization of scientific and technological products is ineffective...
In addition, many other practical supports to improve the business environment and encourage businesses to invest and develop have been decided by the Standing Committee of the National Assembly. The Standing Committee of the National Assembly agreed to issue a resolution on supplementing cases of exemption and reduction of land use fees and land rent for organizations engaged in innovation, research and development of digital technology; projects to produce key digital technology products, software products, semiconductor chips, artificial intelligence, etc. The Standing Committee of the National Assembly also agreed to reduce land rent by 30% in 2025 to support people and businesses to develop production and business with a wider range of applications compared to the 2024 policy.
Finally, it is no coincidence that Resolution No. 66 not only mentions innovation in law-making but also devotes significant space to law enforcement. If a unified, predictable, and business-friendly legal environment is like a wing, then law enforcement is the other wing. For an economy to “take off,” it must have both strong wings.
