Completing the draft Resolution of the National Assembly on a number of special mechanisms and policies to create breakthroughs in law making and enforcement
In Resolution No. 116/NQ-CP dated May 4, 2025, the Government basically agreed on the content of the draft Resolution of the National Assembly on a number of special mechanisms and policies to create breakthroughs in law making and enforcement, submitted by the Ministry of Justice .
The Government assigned the Ministry of Justice to preside over and coordinate with relevant ministries and agencies to study and absorb as much as possible the opinions of Government members, promptly complete the draft Resolution dossier in accordance with the provisions of the Law on Promulgation of Legal Documents, ensuring the following requirements:
- Timely and fully institutionalize the Party's policy on innovation in law-making and enforcement to meet the requirements of national development in Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo, policies on building a socialist rule-of-law state of Vietnam, perfecting the legal system in Party documents, Resolutions, Conclusions of the Politburo, Secretariat; ensure the constitutionality and feasibility of the mechanisms and policies stipulated in the draft Resolution.
- Thoroughly grasp the spirit of innovation in thinking, mechanisms and policies associated with strengthening power control, preventing and combating corruption, negativity, waste, group interests and local interests in the work of building and enforcing laws.
The Ministry of Justice is responsible for receiving comments from Government members and completing the draft documents of the National Assembly's Resolution on a number of special mechanisms and policies to create breakthroughs in law making and enforcement.
The Minister of Justice, authorized by the Prime Minister, on behalf of the Government, signs the Government's Submission on this draft Resolution, and submits it to the National Assembly and the National Assembly Standing Committee in accordance with the provisions of the Law on Promulgation of Legal Documents 2025.
The Government assigned Deputy Prime Minister Le Thanh Long to direct the Ministry of Justice, relevant ministries and agencies in the process of researching and absorbing opinions of National Assembly Deputies, the National Assembly Standing Committee, National Assembly agencies, relevant agencies and organizations, and perfecting the draft Resolution of the National Assembly on a number of special mechanisms and policies to create breakthroughs in law making and enforcement.

Conclusion of Prime Minister Pham Minh Chinh - Head of the Steering Committee at the Second Meeting of the Steering Committee for important national railway projects and works
The Government Office issued Notice No. 213/TB-VPCP dated May 4, 2025, concluding the conclusion of Prime Minister Pham Minh Chinh - Head of the Steering Committee at the Second Meeting of the Steering Committee for important national railway projects and works.
The announcement stated: The Central Executive Committee and the Politburo have reviewed and approved the policies on the Government's proposals related to the development of the railway sector, including: upgrading existing railway lines; continuing to implement suspended and delayed railway lines; implementing large-scale railway projects, such as the high-speed railway on the North-South axis, the railway connecting with China and urban railway lines in Hanoi and Ho Chi Minh City. To realize the policies proposed by the Central Executive Committee and the Politburo, the National Assembly has issued Resolutions No. 172/2024/QH15 on the investment policy for the high-speed railway project on the North-South axis; No. 187/2025/QH15 on the investment policy for the Lao Cai - Hanoi - Hai Phong railway project; No. 188/2025/QH15 on piloting a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City.
At the first meeting of the Steering Committee, the Prime Minister assigned 24 tasks to ministries, branches and localities focusing on removing difficulties and obstacles, speeding up investment preparation procedures for projects. According to the report of the Ministry of Construction, the tasks have basically been implemented on schedule, except for the draft Resolution on implementing Resolution No. 188/2025/QH15, the People's Committees of Hanoi and Ho Chi Minh City have been slow in implementation. The Prime Minister acknowledged the achievements of ministries, branches and localities in organizing the implementation of assigned tasks; welcomed the Ministry of Construction, the Ministry of Justice, and the People's Committee of Hai Phong City for proactively implementing the tasks and implementing the direction of the Government leaders. At the same time, he commended and highly appreciated the careful and complete preparation of documents and reports by the Ministry of Construction at the second meeting of the Steering Committee under the conditions that the Ministry of Construction is carrying out many tasks and has a short preparation time.
The tasks in the coming time are extremely heavy, the progress requirements are very urgent, especially the tasks of the Ministry of Construction. The Prime Minister requested that agencies continue to mobilize maximum resources for railway projects; review and strengthen human resources (state management agencies at all levels, project management boards, consulting units, etc.), in which continue to focus on the following tasks:
Firstly , continue to review and perfect mechanisms and policies, mobilize resources, diversify capital sources (including: central and local capital, loans, issuance of government and enterprise bonds, public-private partnerships, etc.); promptly report to the National Assembly and the National Assembly Standing Committee to supplement and update appropriate specific policies and mechanisms to enhance decentralization, reduce investment procedures; develop the railway industry, master railway technology suitable to Vietnam's conditions.
Second , focus on synchronously implementing key railway projects such as the North-South high-speed railway, railways connecting with China, railways connecting key economic regions, urban railways in Hanoi and Ho Chi Minh City; urgently and quickly resolve problems related to site clearance, investment procedures, etc., in which priority is given to choosing the route of railway projects based on the principle of "shortest and straightest possible; tunneling through mountains; building bridges across rivers".
Third , increase the application of technology, improve the quality and efficiency of operations; access and apply advanced technologies in construction, management and exploitation of railways (such as building information modeling - BIM ...); train high-quality human resources to operate modern railway systems, meeting long-term development requirements (it is necessary to have short-term, medium-term and long-term training plans at the levels of technical workers, engineers, doctors ...); must mobilize corporations, state-owned and private enterprises with technological and production capacity to participate in projects and develop the railway industry; must receive and master modern technology, scientific and intelligent management to develop the railway industry, serving the industrialization and modernization of the country.
Ensuring the goal of synchronous implementation of railway projects
The Prime Minister requested members of the Steering Committee, ministries, branches, localities and units to "be faster, faster; be bolder, be bolder", promote the sense of responsibility, assign "clearly people, clear work, clear time, clear results, clear responsibilities, clear authority", "look far, look wide, think deeply, do big things", deploy work quickly, decisively, decisively, create motivation, inspire work. Ministries, branches and agencies, according to their functions, tasks and powers, must be proactive, active, closely follow the Party's guidelines and policies, the State's policies and laws, the resolutions, conclusions and directions of the Central Committee, the Politburo, the National Assembly, the Government and the Prime Minister to organize and ensure the goal of synchronously deploying railway projects; Ensure the plan to start construction of the Lao Cai - Hanoi - Hai Phong route by the end of 2025 and start construction of the high-speed railway project on the North - South axis by the end of 2026. During the implementation process, agencies, units, and project management boards must absolutely not allow negativity, waste, or group interests to occur.
The Prime Minister requested the Ministry of Construction to absorb and complete the pilot Resolution on specific and special policies and mechanisms in investment in the construction of railway infrastructure systems; send it to the Ministry of Justice for appraisal; ensure the progress of submission to the National Assembly at the 9th session of the 15th National Assembly for consideration on May 5, 2025; focus on developing the Prime Minister's Decision regulating the list of railway industrial services and goods assigned to state-owned organizations and enterprises or ordered to Vietnamese organizations and enterprises (including private enterprises) and the Decree regulating the criteria for selecting state-owned organizations and enterprises assigned with tasks or Vietnamese organizations and enterprises ordered to provide railway industrial services and goods; strive to do so no later than June 15, 2025.
At the same time, the Ministry of Construction will coordinate with the Ministry of Education and Training to complete the Human Resources Development Project, to be completed in June 2025; preside over and coordinate with ministries, Viettel Group, VNPT Group and relevant agencies to select appropriate implementation options in assigning enterprises to receive and transfer railway signal information technology to serve railway projects; to be completed in June 2025.
The Ministry of Construction shall preside over and coordinate with the People's Committees of Hanoi and Ho Chi Minh City to complete and submit to the Government a Resolution implementing Resolution No. 188/2025/QH15 of the National Assembly, to be completed before May 15, 2025; preside over the development and promulgation of a complete system of Regulations and Standards applicable to railway projects (to be completed in May 2025).
The Ministry of Finance shall review the central and local regular expenditure savings in 2025 to prioritize project implementation; report to the Prime Minister in May 2025; continue to direct and organize the preparation of the Project on restructuring Vietnam Railways Corporation, to be completed in June 2025.
The Ministry of Agriculture and Environment urgently develops a Decree regulating the temporary use and return of forests to carry out temporary construction works serving the project, to be completed in June 2025.
The Ministry of Science and Technology urgently speeds up the progress of drafting a Decree regulating the development of railway science and technology and detailed regulations on research, application, and technology transfer according to simplified procedures; to be completed in May 2025; to coordinate with the Ministry of Construction to develop and promulgate a complete system of Regulations and Standards applicable to railway projects (to be completed in May 2025).
The Ministry of Industry and Trade completes the Railway Industry Development Project and submits it to the Government for promulgation in June 2025; presides over and coordinates with the Vietnam Electricity Group to review and guide investors on power supply and power systems for electrified railway projects; and continues to review electricity demand to ensure supply for railway projects; to be completed in June 2025.
The Prime Minister requested the People's Committees of Hanoi and Ho Chi Minh City to urgently complete the content of the Government's Resolution implementing Resolution No. 188/2025/QH15 and send it to the Ministry of Construction for synthesis and submission to the Government, and submit it to the Government before May 15, 2025.
On the basis of the decentralized and authorized tasks, proactively carry out the work to implement urban railway projects. In case of difficulties without specific and special regulations and mechanisms, urgently seek guidance from relevant ministries and branches to continue implementing the projects to ensure quality and progress.
Localities where the project passes through shall take the lead in organizing the implementation of compensation, support and resettlement of the project; establish a Steering Committee for site clearance (the Provincial Party Secretary and City Party Committee Secretary shall be the Head of the Committee) and a Steering Committee Support Team: the Lao Cai - Hanoi - Hai Phong project shall be completed by May 5, 2025, and the high-speed railway project on the North - South axis shall be completed before July 1, 2025. Request the Ministry of Construction to assign the Railway Project Management Board to send staff to participate in the Steering Committees of the localities; promptly develop an implementation plan and allocate local budget capital to deploy the construction of resettlement areas; carry out site clearance work according to the project policy, build resettlement areas to serve the project without having to establish an investment policy (meeting the progress of the projects).
Vietnam Railway Corporation urgently coordinates with the Hanoi People's Committee to implement procedures for allocating land for the Railway Industrial Complex to serve railway projects according to regulations; coordinates with the Ministry of Construction in the process of developing the Prime Minister's Decision regulating the list of railway industrial services and goods assigned to organizations and enterprises and the Decree stipulating criteria for selecting state-owned organizations and enterprises assigned tasks or Vietnamese organizations and enterprises ordered to provide railway industrial services and goods, clearly defining the tasks that the Corporation can undertake to serve the development of the railway industry.
The Prime Minister also gave instructions on a number of key railway projects. Specifically:
Lao Cai - Hanoi - Hai Phong Railway Project
The Prime Minister requested the Ministry of Construction to promptly receive and fully explain the opinions of Government members, complete the draft Resolution of the Government implementing Resolution No. 187/2025/QH15 of the National Assembly, and submit it to the Government on May 5, 2025.
Take the lead in working with localities to agree on the scale and route of the Project in May 2025 as a basis for implementing site clearance, survey, design and preparation of the Project Feasibility Study Report; urgently implement investment preparation procedures to ensure the project starts construction in December 2025.
Localities urgently deploy site clearance work to ensure completion in 2025.
North-South high-speed railway project
The Prime Minister requested the Ministry of Construction to complete the draft Resolution on special mechanisms and submit it to the National Assembly for approval at the 9th session of the 15th National Assembly (to be submitted to the Government on May 5, 2025).
Ministries, branches and localities shall base on the plan approved by the Government in Resolution 106/NQ-CP to organize implementation to meet the project commencement schedule by the end of 2026.
Urban railway lines
For route No. 3 (Hanoi - Yen So), the Prime Minister requested the Ministry of Finance to urgently implement the direction of Deputy Prime Minister Bui Thanh Son in Official Dispatch No. 2719/VPCP-QHQT dated April 1, 2025, complete the Proposal Document, submit to the Prime Minister for consideration and approval of the proposal to use ODA capital/preferential loans according to the proposal of the Hanoi People's Committee, to be completed by May 5, 2025.
For route No. 2 (Ho Chi Minh City - Tham Luong), Ho Chi Minh City People's Committee urgently received and completed the dossier and drafted the Decision according to Document No. 3084/VPCP-QHQT dated April 11, 2025 on stopping the use of ODA capital, switching to public investment capital, and submitting it to the Prime Minister on May 5, 2025.
The People's Committees of Hanoi and Ho Chi Minh City urgently coordinate with the Ministry of Construction to complete the Government's Resolution implementing Resolution 188/2025/QH15.
The Prime Minister assigned the Ministry of Construction (the standing agency of the Steering Committee) to preside over and coordinate with the Government Office to monitor, urge and guide localities, agencies and units to implement the above assigned tasks; promptly report to the Prime Minister, Deputy Prime Minister Tran Hong Ha and Deputy Prime Minister Ho Duc Phoc for direction and removal of difficulties and obstacles.

Plan to implement the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site
Prime Minister Pham Minh Chinh signed Decision No. 862/QD-TTg promulgating the Plan to implement the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site (Plan).
The purpose of the Plan is to specifically define the work content, deadline, completion progress and responsibilities of relevant agencies and units in implementing the Ordinance, ensuring timeliness, synchronization, unity, effectiveness and efficiency; to define responsibilities and coordination mechanisms between ministries, ministerial-level agencies, government agencies, localities and relevant agencies and units in implementing the Ordinance nationwide. To raise awareness and responsibility of all levels, sectors and people in implementing the Ordinance.
Reviewing sub-law legal documents related to the management and protection of the Ho Chi Minh Mausoleum Relic Site
According to the Plan, ministries and ministerial-level agencies shall organize the review of legal documents issued by themselves, jointly issued or submitted to competent authorities for issuance, and send the review results to the Ministry of National Defense for synthesis and reporting to the Prime Minister. The completion date is before May 19, 2025.
Before May 19, 2025, the Hanoi People's Committee shall preside over and direct its affiliated units to coordinate with relevant localities to review and systematize documents issued by it; issue documents within its authority or propose the Government and the Prime Minister to amend, supplement and issue documents under the authority of the Government and the Prime Minister, and send them to the Ministry of National Defense for synthesis.
Develop and promulgate detailed regulations and enforcement measures of the Ordinance.
The Ministry of National Defense shall preside over and coordinate with the Ministry of Justice, the Government Office and relevant ministries and branches to develop a Decree detailing a number of articles and measures to implement the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site (Clause 5, Article 14, Clause 5, Article 17, Clause 2, Article 18, Clause 2, Article 26, Clause 3, Article 31); promulgate according to simplified procedures. Submission deadline is before May 10, 2025.
The Minister of National Defense shall preside over and coordinate with relevant ministries and agencies to develop and promulgate the following Circulars: Circular detailing a number of articles of the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site under the management of the Ministry of National Defense (Clause 2, Article 12, Clause 3, Article 13, Clause 2, Article 16, Clause 2, Article 29); Circular regulating the national flag raising and lowering ceremony (Clause 3, Article 19). Submission deadline is May 10, 2025.
The Ministry of National Defense shall preside over and coordinate with relevant ministries and branches to compile documents serving the propaganda and dissemination of the contents of the Ordinance on Management and Protection of the Ho Chi Minh Mausoleum Relic Site and documents guiding the implementation of the Ordinance.
In the last 6 months of 2025, the Ministry of National Defense shall preside over and coordinate with ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally run cities; state administrative agencies, public service units, local authorities, and state-owned enterprises in the areas with works and areas belonging to the Ho Chi Minh Mausoleum Relic Site to organize conferences (in person and online) to disseminate the Ordinance and documents detailing a number of articles of the Ordinance.

Promote decentralization and delegation according to the provisions of the Law on Organization of Government, the Law on Organization of Local Government and implement the model of 2-level local government.
Permanent Deputy Prime Minister Nguyen Hoa Binh - Deputy Head of the Steering Committee for summarizing the implementation of Resolution 18-NQ/TW of the Government signed Document No. 48/CV-BCĐTKNQ18 on promoting decentralization and delegation according to the provisions of the Law on Organization of the Government, the Law on Organization of Local Government and implementing the 2-level local government model.
The document states: Implementing the policy of promoting decentralization and delegation according to the direction of the Politburo in Official Dispatch No. 13078-CV/VPTW dated January 14, 2025 of the Office of the Central Executive Committee, institutionalized in Clause 2, Article 32 of the Law on Organization of the Government 2025, Clause 1, Article 50 of the Law on Organization of Local Government 2025, the Prime Minister issued Decision No. 608/QD-TTg dated March 15, 2025 on the plan to implement tasks and solutions to promote decentralization and delegation according to the provisions of the Law on Organization of the Government and the Law on Organization of Local Government; At the same time, based on Plan No. 47-KH/BCĐ dated April 14, 2025 of the Central Steering Committee on summarizing Resolution No. 18-NQ/TW on the implementation of the arrangement and merger of provincial and communal administrative units and the organization of the 2-level local government system, the Prime Minister issued Decision No. 758/QD-TTg and Decision No. 759/QD-TTg dated April 14, 2025, which identified the tasks, solutions and assigned specific responsibilities to ministries, branches and localities for implementation. In order to focus on effectively implementing the tasks in the above Plans, especially in priority and urgent areas, the Prime Minister, Head of the Steering Committee on summarizing the implementation of Resolution No. 18-NQ/TW of the Government, requested the heads of ministries, branches and localities to urgently implement the following contents:
1- Clearly identify priority and urgent issues of sectors and fields under management; review the entire system of related specialized legal documents; develop and submit to the Government for promulgation of legal documents within its authority to promptly adjust the authority of the Government, Prime Minister, Ministers, and local authorities according to the requirements of promoting decentralization and delegation of power, in sync with the implementation of the 2-level local government model, creating a legal corridor, promptly handling practical issues, removing institutional "bottlenecks", contributing to the implementation of socio-economic development goals according to Resolution No. 192/2025/QH15 dated February 19, 2025 of the National Assembly. Completion date before June 30, 2025.
2- Closely follow the content of the task requirements in Decision No. 608/QD-TTg dated March 15, 2025, Decision No. 758/QD-TTg dated April 14, 2025, Decision No. 759/QD-TTg dated April 14, 2025, issue according to authority or submit to competent authorities to issue regulations and instructions to promote decentralization and delegation of power associated with the task of implementing the construction of a 2-level local government organization model, ensuring progress and quality as required.
3- Some general requirements when drafting legal documents
a) Thoroughly grasp the spirit of innovation in law-making thinking according to the requirements of the General Secretary and the viewpoint of promoting decentralization and delegation to create initiative for localities in the spirit of: "locality decides, locality does, locality takes responsibility" associated with the implementation of the 2-level local government model.
b) For issues identified as falling under the authority of the National Assembly, it is necessary to clarify the basis for proposals to ensure that these issues are fundamental and important national issues, consistent with the spirit of the Constitution.
c) Based on the principle of delimitation of authority in the Law on Organization of the Government and the Law on Organization of Local Government in 2025, it is required that: (1) The names of ministries, branches and specific tasks and powers of ministries and branches are not specified in the Law (no direct delegation of authority to Ministers in the Law ensures the Government's unified state management of sectors and fields, and assigns the scope of state management to ministries and ministerial-level agencies; (2) Clearly define the responsibilities of Ministers and Heads of ministerial-level agencies for sectors and fields assigned to them for management, avoiding pushing responsibility onto the Prime Minister (the Prime Minister leads the work of the Government, does not decide on specific issues under the responsibility of Ministers and Heads of ministerial-level agencies as members of the Government for sectors and fields assigned to them for management).
The implementation results are sent to the Ministry of Home Affairs (Standing Agency of the Steering Committee) periodically before the 20th of each month for monitoring, synthesis, and reporting to competent authorities according to regulations./.
