Directive on promoting the implementation of solutions to promote biofuel consumption in Vietnam

In recent times, the Ministry of Industry and Trade has presided over and coordinated with relevant ministries, branches and agencies to carry out many activities to implement Decision No. 53/2012/QD-TTg dated November 22, 2012 of the Prime Minister on promulgating a roadmap for applying the blending ratio of biofuels with traditional fuels (Decision No. 53/2012/QD-TTg) such as: Issuing guiding documents; Coordinating with localities and enterprises to promote production to ensure the supply of Ethanol to meet the demand for blending biofuels with traditional fuels; Organizing propaganda activities to raise awareness among people and enterprises about the economic benefits and environmental protection of biofuels; Proposing solutions and policies to support enterprises distributing biofuels; International cooperation with a number of prestigious organizations in the world to develop biofuels in Vietnam; Coordinate with ministries, branches and localities in inspecting and supervising the implementation of the roadmap and during the implementation process, promptly conduct research and propose adjustments to the roadmap to suit the practical situation. Thanks to the above efforts, from January 1, 2018, E5 RON92 gasoline has been produced and traded nationwide.

Although the Ministry of Industry and Trade is very determined and has been implementing many solutions to encourage the use of biofuels, the trend of using this fuel has not been as expected. In this situation, the Minister of Industry and Trade requests relevant units and agencies under the Ministry of Industry and Trade, Departments of Industry and Trade of provinces/cities under the Central Government, Vietnam Petroleum Association and petroleum traders, and enterprises producing E100 fuel Ethanol to seriously continue to implement the following specific tasks and solutions:

1. Domestic Market Department

a) Continue to coordinate with relevant units to strengthen, monitor and urge localities and petroleum traders to promote the sale of biofuel gasoline (E5 RON92, E100) to supply the market.

b) Direct key petroleum traders to report to the Ministry of Industry and Trade every 3 months on the implementation of E5 RON 92 gasoline trading to grasp difficulties in the implementation process.

c) Coordinate with the Ministry of Finance and relevant agencies and units to review documents and research and develop a pricing mechanism to ensure the attractiveness of using E5 RON92 biofuel.

d) Closely coordinate with the Department of Science and Technology and relevant units to organize inspection, review, and assessment of the situation and results of implementing the biofuel blending roadmap according to Decision No. 53/2012/QD-TTg.

d) Closely coordinate with media agencies to regularly and fully inform about the supply of petroleum, the management of the petroleum market by the Ministry of Industry and Trade - Finance and related ministries and branches, creating a stable and consensus mentality in public opinion. Strengthen communication and information, encourage the community to use biofuels .

2. Department of Science and Technology

a) Preside over and coordinate with relevant functional units under the Ministry to review and evaluate the situation and results of the implementation of the biofuel roadmap according to Decision No. 53/2012/QD-TTg . Report, advise and submit to competent authorities for consideration of amending, supplementing and perfecting Decision No. 53/2012/QD-TTg to suit the current practical situation.

b) Preside over and coordinate with relevant functional units of the Ministry in developing, amending and supplementing technical regulations and standards on the quality of petroleum products. Develop and submit to the Ministry's leaders for promulgation of national technical regulations for bio-fuels that will be produced and circulated on the market in the coming time.

c) Implement circular economy research on the production, trading, use and environmental efficiency of biofuel.

d) Continue to coordinate with regional and international organizations in implementing activities to support review, research, application, production, communication capacity enhancement and promotion of biofuel development in accordance with domestic needs and practical situations regarding biofuel development in Vietnam.

d) Provide basic information to media units to clarify the benefits of using E5 RON92 gasoline, affirming the quality and technology so that consumers can feel secure when using E5 RON92 gasoline. Continue to coordinate with the Ministry of Information and Communications and the Ministry's media units to promote the National Communication Program to encourage the community to use biofuels.

3. Oil, Gas and Coal Department

a) Coordinate with relevant units to continue monitoring and reviewing the production and business activities of fuel ethanol factories, research and propose solutions in accordance with current regulations to support E100 fuel ethanol factories for the market.

b) Develop reports and research to propose policies to support businesses that produce or import E100 and blend biofuel.

4. Import and Export Department:

Develop a report on the implementation of trade policies for imported E100 and domestic E100 production materials, and send it to the Department of Science and Technology for synthesis and reporting to the Leaders.

5. General Department of Market Management

a) Strengthen inspection and supervision of the implementation of the Roadmap for applying the blending ratio of biofuels with traditional fuels, promptly inspect and strictly handle violations in the petroleum business, including biofuels .

b) Direct the Market Management Departments of provinces and cities to coordinate with local Departments of Industry and Trade to deploy professional measures , develop plans, and conduct regular and surprise inspections of law enforcement in petroleum and biofuel trading activities of enterprises; strictly handle acts of hoarding goods to wait for price increases and profiteering in petroleum and biofuel trading activities.

6. Ministry Inspectorate

Advise on the development, revision and implementation of the annual inspection and examination plan of the Ministry of Industry and Trade, including strengthening the inspection and examination of compliance with legal regulations in petroleum trading activities, including bio-fuel for petroleum traders nationwide to promptly detect and strictly handle violations according to regulations.

7. Legal Department

a) Review and propose regulations in legal documents in the field of petroleum business, including bio-fuel, to amend and supplement them to suit the reality and regulations of current laws.

b) Preside over and coordinate with relevant units to strengthen the work of monitoring law enforcement, propagating and disseminating regulations in the field of petroleum and biofuel trading according to assigned functions and tasks.

8. Ministry Office, information and communication units under the Ministry

a) Develop and propose plans, strategies and budgets to continue implementing information activities on the supply of gasoline, including biofuel, policies and directions of the Government and local ministries and branches on ensuring gasoline supply for the market to create consensus in public opinion, avoid spreading false news that causes confusion and market instability .

b) Actively and proactively promote information and propaganda work about E5 RON92 gasoline, in which it is necessary to clarify the benefits of using E5 RON92 gasoline, affirm the quality and technology so that consumers can feel secure in using it, in order to encourage the community to increase the use of biofuels.

9. Relevant units of the Ministry

According to assigned functions and tasks, actively coordinate to perform the above tasks well.

10. Department of Industry and Trade of provinces and centrally run cities

a) Continue to strengthen, direct and guide local petroleum traders to promote the trading of E5 RON 92 gasoline, summarize difficulties and problems in the process of organizing the trading of E5 RON 92 gasoline and send them to the Ministry of Industry and Trade for timely solutions.

b) Continue to coordinate with local Departments, Boards, and sectors, and local petroleum traders to promote information and propaganda to create consensus in society on the use of biofuels in general, and E5 RON 92 gasoline in particular, affirming the quality and techniques so that consumers can feel secure in using them, in order to encourage the community to increase the use of biofuels.

11. Vietnam Petroleum Association

a) Thoroughly educate members to seriously implement Decision No. 53/2012/QD-TTg dated November 22, 2012 of the Prime Minister on the roadmap for applying the blending ratio of biofuels with traditional fuels.

b) Participate in proposing mechanisms and policies to support biofuel development, including tax and fee incentives or other forms of support to reduce costs and enhance the competitiveness of biofuels in order to expand the biofuel consumption market.

12. Petroleum traders

a) Key traders in petroleum business:

- Ensure the supply of E5 RON 92 bio-fuel to meet market demand according to the roadmap specified in Decision No. 53/2012/QD-TTg. Report the implementation status to the Ministry of Industry and Trade (Domestic Market Department and Department of Science and Technology) before the 28th of each quarter for synthesis reporting.

- Focus on sharing supply sources and profits in the distribution system in a reasonable manner to ensure uninterrupted supply of gasoline to the market. Support and encourage distributors and retailers in the business system to promote biofuel consumption through incentive programs and appropriate pricing policies to increase competitiveness compared to traditional mineral gasoline.

- Responsible for providing complete and timely data to competent authorities (Ministry of Finance, Ministry of Industry and Trade, etc.) to serve as a basis for accurate updating and calculating all costs of petroleum business in the formula for calculating the basic price of petroleum and biofuel products, ensuring efficiency in the management and stabilization of petroleum prices, harmonizing the interests of the State, enterprises and people.

b) Key traders and petroleum distributors:

- Actively coordinate with relevant agencies to propose mechanisms and policies to support the development of biofuels, including tax and fee incentives or other forms of support to reduce costs and enhance the competitiveness of biofuels in order to expand the biofuel consumption market, especially in localities and regions with great consumption potential.

- Actively coordinate with the People's Committees and Departments of Industry and Trade of provinces/cities under the Central Government to promote information and propaganda on the use of E5 RON 92 gasoline, affirming its quality and technology so that consumers can feel secure in using it, in order to encourage the community to increase the use of biofuels.

13. Implementation effectiveness and responsibility for implementation

a) This Directive takes effect from the date of signing.

b) The Chief of the Ministry's Office, the Director General of the General Department of Market Management, the Chief Inspector of the Ministry, the Director of the Import-Export Department, the Directors of the Departments: Domestic Market, Oil and Gas and Coal, Science and Technology, Legal Affairs, the Departments of Industry and Trade of provinces and centrally run cities, the Vietnam Petroleum Association and the main petroleum traders and petroleum distributors are responsible for implementing this Directive.

c) During the implementation process, if there are any difficulties or problems, relevant agencies, organizations and enterprises are requested to report and reflect in writing to the Ministry of Industry and Trade (Domestic Market Department) for synthesis and handling.
